SENATE CONCURRENT

RESOLUTION

 

 

AUTHORIZATION TO ISSUE a quitclaim deed to the county of maui for a remnant portion of a state owned road right-of-way at waiakoa, WAILUKU, maui.

 

 


     WHEREAS, the parcel of land is situated at Waiakoa, Wailuku, Maui identified by Tax Map Key:  (2) 3-9-06:  "20 Foot Right-of-Way", containing an area of 3,979 square feet; and

 

     WHEREAS, the parcel is a road remnant that has been unused and unmaintained for several decades; and

 

     WHEREAS, the Hawaii Conference Foundation, on behalf of Keolahou Congregational Hawaiian Church, is the only abutting property owner in the immediate vicinity of the road remnant and has expressed an interest in owning, cleaning, and maintaining the parcel in order to improve safety of ingress, egress, and circulation for vehicles arriving and departing the church property; and

 

     WHEREAS, the County of Maui has expressed an interest in disposing of the unused and unmaintained road remnant for fair market value pursuant to Maui County Code, section 3.44.050, Disposition by Negotiation; and

 

     WHEREAS, approval by the Board of Land and Natural Resources is required for the issuance of a quitclaim deed to the County of Maui for the disposition of the road remnant; and

 

     WHEREAS, on May 24, 1996, under agenda item D-4, the Board of Land and Natural Resources approved the quitclaim of the State's interest in the road remnant to the County of Maui; and

 

     WHEREAS, subsequent staffing changes and personnel involvement at state and county agencies and at Keolahou Church resulted in the disposition of the road remnant not being completed; and

 

     WHEREAS, chapter 264, Hawaii Revised Statutes, states in part that all public highways other than state or federal aid highways under the jurisdiction of the State Department of Transportation are county highways; and

 

     WHEREAS, the County of Maui requires documentation of the transfer of ownership of the road remnant from the Board of Land and Natural Resources to the County of Maui in order to complete the disposal process; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, the House of Representatives concurring, that the Board of Land and Natural Resources is hereby authorized to issue a quitclaim deed conveying the parcel of land situated at Waiakoa, Wailuku, Maui identified by Tax Map Key:  (2) 3-9-06:  "20 Foot Right-of-Way", containing an area of 3,979 square feet to the County of Maui; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, Mayor of the County of Maui, and Chairperson of Maui County Council.
