  1  1    Section 1.  Section 144.46, subsection 2, Code 2018, is
  1  2 amended to read as follows:
  1  3    2.  Fees collected by the state registrar and by the county
  1  4 registrar on behalf of the state under this section shall
  1  5 be deposited in the general fund of the state and the vital
  1  6 records fund established in section 144.46A in accordance
  1  7 with an apportionment established by rule. Fees County fees
  1  8  collected by the county registrar pursuant to section 331.605,
  1  9 subsection 1, paragraph paragraphs "f" and "g", shall be
  1 10 deposited in the county general fund.
  1 11    Sec. 2.  Section 331.605, subsection 1, paragraphs f and g,
  1 12 Code 2018, are amended to read as follows:
  1 13    f.  A county fee of four dollars for the issuance of a
  1 14 certified copy of a birth record, death record, or marriage
  1 15 certificate other than the copy issued pursuant to paragraph
  1 16 "g".  The county fee collected pursuant to this paragraph shall
  1 17 be an amount equal to forty percent of the fee established
  1 18 by the department of public health for the applicable record
  1 19 pursuant to section 144.46.
  1 20    g.  For filing an application for the license to marry,
  1 21 thirty=five dollars, which includes payment for one certified
  1 22 copy of the original certificate of marriage, to be issued
  1 23 following filing of the original certificate of marriage, four
  1 24  fourteen dollars of which shall be retained by the county
  1 25 pursuant to paragraph "f" as a county fee. For issuing an
  1 26 application for an order of the district court authorizing the
  1 27 validation of a license to marry before the expiration of three
  1 28 days from the date of issuance of the license, five dollars.
  1 29 The district court shall authorize the early validation of a
  1 30 marriage license without the payment of any fees imposed in
  1 31 this paragraph upon showing that the applicant is unable to pay
  1 32 the fees.
  1 33                           EXPLANATION
  1 34 The inclusion of this explanation does not constitute agreement with
  1 35 the explanation's substance by the members of the general assembly.
  2  1 This bill relates to fees collected by the county recorder
  2  2 for copies of vital records and applications for marriage
  2  3 licenses.
  2  4    Related to issuance of a certified copy of a birth record,
  2  5 death record, or marriage certificate by a county, the bill
  2  6 requires that the county collect a county fee equal to 40
  2  7 percent of the fee established by the Iowa department of public
  2  8 health for providing those records.
  2  9    Under current law, the fee for filing a marriage application
  2 10 and receiving a copy of the original marriage certificate is
  2 11 set at $35. The bill raises the portion of the fee retained
  2 12 by the county from $4 to $14. Current law also requires a
  2 13 district court to authorize the early validation of a marriage
  2 14 license without the payment of any fees upon showing that an
  2 15 applicant is unable to pay the fees.
