H.F. 2171 Section 1. Section 256.9, subsection 46, paragraph a, Code 1 2024, is amended to read as follows: 2 a. Develop and make available to school districts, examples 3 of age-appropriate and research-based materials and lists 4 of resources which parents may use to teach their children 5 to recognize unwanted physical and verbal sexual advances, 6 to not make unwanted physical and verbal sexual advances, 7 to effectively reject unwanted sexual advances, that it is 8 wrong to take advantage of or exploit another person, about 9 the dangers of sexual exploitation by means of the internet 10 including specific strategies to help students protect 11 themselves and their personally identifiable information 12 from such exploitation, and about counseling, medical, and 13 legal resources available to survivors of sexual abuse and 14 sexual assault, including resources for escaping violent 15 relationships. The materials and resources shall cover verbal, 16 physical, and visual sexual harassment, including nonconsensual 17 sexual advances, and nonconsensual physical sexual contact , 18 and child sexual abuse and child sexual assault awareness and 19 prevention . In developing the materials and resource list, the 20 director shall consult with entities that shall include but 21 not be limited to the departments of health and human services 22 and public safety, education stakeholders, and parent-teacher 23 organizations. School districts shall provide age-appropriate 24 and research-based materials and a list of available community 25 and internet-based resources to parents at registration and 26 shall also include the age-appropriate and research-based 27 materials and resource list in the student handbook. School 28 districts are encouraged to work with their communities to 29 provide voluntary parent education sessions to provide parents 30 with the skills and appropriate strategies to teach their 31 children as described in this subsection . School districts 32 shall incorporate the age-appropriate and research-based 33 materials into relevant curricula and shall reinforce the 34 importance of preventive measures when reasonable with parents 35 -1- LSB 5130YH (6) 90 jda/jh 1/ 4
H.F. 2171 and students. 1 Sec. 2. Section 256.146, Code 2024, is amended by adding the 2 following new subsection: 3 NEW SUBSECTION . 25. Adopt rules pursuant to chapter 17A 4 establishing continuing education requirements for renewal 5 of a license, certificate, authorization, or statement of 6 recognition. Continuing education activities may include 7 participating in or presenting at in-service training programs 8 related to child sexual abuse and child sexual assault 9 awareness and prevention. 10 Sec. 3. Section 279.50, subsections 1, 2, and 3, Code 2024, 11 are amended to read as follows: 12 1. Subject to section 279.80 , each school board shall 13 provide instruction in kindergarten , and in prekindergarten 14 if the school board offers a prekindergarten program, which 15 gives attention to experiences relating to life skills and 16 human growth and development as required in section 256.11 . 17 The human growth and development instruction shall include 18 instruction related to child sexual abuse and child sexual 19 assault awareness and prevention. School districts shall use 20 research provided in section 256.9, subsection 46 , paragraph 21 “b” , to evaluate and upgrade their instructional materials and 22 teaching strategies for human growth and development. 23 2. Subject to section 279.80 , each school board shall 24 provide age-appropriate and research-based instruction in 25 human growth and development including instruction regarding 26 self-esteem, stress management, interpersonal relationships, 27 and domestic abuse in grades one through six. The human growth 28 and development instruction shall include instruction related 29 to child sexual abuse and child sexual assault awareness and 30 prevention. 31 3. Each school board shall provide age-appropriate and 32 research-based instruction in human growth and development 33 including instruction regarding human sexuality, self-esteem, 34 stress management, interpersonal relationships, domestic 35 -2- LSB 5130YH (6) 90 jda/jh 2/ 4
H.F. 2171 abuse, and the prevention and control of disease, including 1 sexually transmitted diseases as required in section 256.11 , in 2 grades seven through twelve. The human growth and development 3 instruction shall include instruction related to child sexual 4 abuse and child sexual assault awareness and prevention. 5 Sec. 4. STATE MANDATE FUNDING SPECIFIED. In accordance 6 with section 25B.2, subsection 3, the state cost of requiring 7 compliance with any state mandate included in this Act shall 8 be paid by a school district from state school foundation aid 9 received by the school district under section 257.16. This 10 specification of the payment of the state cost shall be deemed 11 to meet all of the state funding-related requirements of 12 section 25B.2, subsection 3, and no additional state funding 13 shall be necessary for the full implementation of this Act 14 by and enforcement of this Act against all affected school 15 districts. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to child sexual abuse and child sexual 20 assault awareness and prevention. 21 Current law requires the director of the department of 22 education to develop and make available to school districts 23 examples of age-appropriate and research-based materials. The 24 bill provides that the age-appropriate and research-based 25 materials shall also cover child sexual abuse and child sexual 26 assault awareness and prevention. 27 The bill requires the board of educational examiners to 28 adopt rules that establish continuing education requirements 29 for renewal of a license, certificate, authorization, or 30 statement of recognition. The bill establishes that continuing 31 education activities may include participating in or presenting 32 at in-service training programs related to child sexual abuse 33 and child sexual assault awareness and prevention. 34 The bill requires school districts to provide 35 -3- LSB 5130YH (6) 90 jda/jh 3/ 4
H.F. 2171 age-appropriate and research-based instruction related to child 1 sexual abuse and child sexual assault awareness and prevention 2 as part of its human growth and development instruction in 3 kindergarten through grade 12, and in prekindergarten if the 4 school district offers a prekindergarten program. 5 The bill may include a state mandate as defined in Code 6 section 25B.3. The bill requires that the state cost of 7 any state mandate included in the bill be paid by a school 8 district from state school foundation aid received by the 9 school district under Code section 257.16. The specification 10 is deemed to constitute state compliance with any state mandate 11 funding-related requirements of Code section 25B.2. The 12 inclusion of this specification is intended to reinstate the 13 requirement of political subdivisions to comply with any state 14 mandates included in the bill. 15 -4- LSB 5130YH (6) 90 jda/jh 4/ 4
