From the moneys deposited in the school ready children 21 grants account for the fiscal year beginning July 1, 2014, 22 and ending June 30, 2015, not more than $132,975 $265,950 23 is allocated for the early childhood Iowa office and other 24 technical assistance activities. The early childhood Iowa 25 state board shall direct staff to work with the early childhood 26 stakeholders alliance created in section 256I.12 to inventory 27 technical assistance needs. Moneys allocated under this 28 lettered paragraph may be used by the early childhood Iowa 29 state board for the purpose of skills development and support 30 for ongoing training of staff. However, except as otherwise 31 provided in this subsection, moneys shall not be used for 32 additional staff or for the reimbursement of staff. 33 b. As a condition of receiving moneys appropriated in 34 this subsection, each early childhood Iowa area board shall 35 -7- SF 2347 (3) 85 kh/tm/jh 7/ 37
S.F. 2347 report to the early childhood Iowa state board progress on 1 each of the local indicators approved by the area board. Each 2 early childhood Iowa area board must also submit an annual 3 budget for the area’s comprehensive school ready children 4 grant developed for providing services for children from birth 5 through five years of age, and provide other information 6 specified by the early childhood Iowa state board, including 7 budget amendments as needed. The early childhood Iowa state 8 board shall establish a submission deadline for the annual 9 budget and any budget amendments that allow a reasonable period 10 of time for preparation by the early childhood Iowa area boards 11 and for review and approval or request for modification of 12 the materials by the early childhood Iowa state board. In 13 addition, each early childhood Iowa area board must continue to 14 comply with reporting provisions and other requirements adopted 15 by the early childhood Iowa state board in implementing section 16 256I.9 . 17 c. Of the amount appropriated in this subsection for 18 deposit in the school ready children grants account of the 19 early childhood Iowa fund, $1,159,009 $2,318,018 shall 20 be used for efforts to improve the quality of early care, 21 health, and education programs. Moneys allocated pursuant to 22 this paragraph may be used for additional staff and for the 23 reimbursement of staff. The early childhood Iowa state board 24 may reserve a portion of the allocation, not to exceed $44,325 25 $88,650 , for the technical assistance expenses of the early 26 childhood Iowa state office, including the reimbursement of 27 staff, and shall distribute the remainder to early childhood 28 Iowa areas for local quality improvement efforts through a 29 methodology identified by the early childhood Iowa state board 30 to make the most productive use of the funding, which may 31 include use of the distribution formula, grants, or other 32 means. 33 d. Of the amount appropriated in this subsection for 34 deposit in the school ready children grants account of the 35 -8- SF 2347 (3) 85 kh/tm/jh 8/ 37
S.F. 2347 early childhood Iowa fund, $412,515 $825,030 shall be used for 1 support of professional development and training activities 2 for persons working in early care, health, and education by 3 the early childhood Iowa state board in collaboration with 4 the professional development component group of the early 5 childhood Iowa stakeholders alliance maintained pursuant to 6 section 256I.12, subsection 7 , paragraph “b”, and the early 7 childhood Iowa area boards. Expenditures shall be limited to 8 professional development and training activities agreed upon by 9 the parties participating in the collaboration. 10 9. EARLY CHILDHOOD IOWA FUND —— PRESCHOOL TUITION 11 ASSISTANCE 12 a. For deposit in the school ready children grants account 13 of the early childhood Iowa fund created in section 256I.11 : 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,714,438 15 5,428,877 16 b. The amount appropriated in this subsection shall be 17 used for early care, health, and education programs to assist 18 low-income parents with tuition for preschool and other 19 supportive services for children ages three, four, and five 20 who are not attending kindergarten in order to increase the 21 basic family income eligibility requirement to not more than 22 200 percent of the federal poverty level. In addition, if 23 sufficient funding is available after addressing the needs of 24 those who meet the basic income eligibility requirement, an 25 early childhood Iowa area board may provide for eligibility 26 for those with a family income in excess of the basic income 27 eligibility requirement through use of a sliding scale or other 28 copayment provisions. 29 10. EARLY CHILDHOOD IOWA FUND —— FAMILY SUPPORT AND PARENT 30 EDUCATION 31 a. The amount appropriated in this subsection shall be 1 used for family support services and parent education programs 2 targeted to families expecting a child or with newborn and 3 infant children through age five and shall be distributed using 4 the distribution formula approved by the early childhood Iowa 5 state board and shall be used by an early childhood Iowa area 6 board only for family support services and parent education 7 programs targeted to families expecting a child or with newborn 8 and infant children through age five. 9 11. BIRTH TO AGE THREE SERVICES 10 For expansion of the federal Individuals with Disabilities 11 Education Improvement Act of 2004, Pub. L. The 31 projects shall promote healthy prenatal outcomes and healthy 32 family functioning, and strengthen the development of infants 33 and toddlers in low-income families. Section 256.7, subsection 31, Code 2014, is amended 6 by adding the following new paragraph: 7 NEW PARAGRAPH . c. Adopt rules to establish standards 8 for the identification, selection, and use of research-based 9 educational and instructional models for students identified as 10 limited English proficient, and standards for the professional 11 development of the instructional staff responsible for 12 implementation of those models. 13 Sec. 8. Section 256.9, subsection 53, paragraph c, 14 unnumbered paragraph 1, Code 2014, is amended to read as 15 follows: 16 Establish, subject to an appropriation of funds by the 17 general assembly, an Iowa reading research center which shall 18 collaborate with the area education agencies in implementing 19 the provisions of this paragraph “c” . 20 Sec. 9. Section 256.9, subsection 53, paragraph c, 21 subparagraph (3), Code 2014, is amended to read as follows: 22 (3) The center shall submit a detailed annual financial 23 report , a description of its the center’s activities for 24 the prior fiscal year, and a statement of its proposed and 25 projected activities to the general assembly by January 15 26 annually. 27 Sec. 10. Section 256.9, subsection 63, paragraph b, Code 28 2014, is amended to read as follows: 29 b. Develop and implement in collaboration with education 30 stakeholders, a coaching and support system for administrators . 31 The coaching and support system shall be aligned with the 32 beginning administrator mentoring and induction program 33 created pursuant to section 284A.5 and shall also be designed 34 to support administrators in school districts approved to 35 -25- SF 2347 (3) 85 kh/tm/jh 25/ 37
S.F. 2347 implement the framework and comparable systems set forth 1 pursuant to sections 284.15, 284.16, and 284.17 . For the 2 fiscal year beginning July 1, 2017, and each subsequent fiscal 3 year, the coaching and support system for administrators shall 4 be available to any school district whether or not the district 5 has been approved to implement the framework and comparable 6 systems set forth pursuant to sections 284.15, 284.16, and 7 284.17. 8 Sec. 11. Section 256.9, Code 2014, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 65. Establish an English language literacy 11 for all grant program which shall be made available to all 12 school districts. Priority in issuing grants shall be given 13 to school districts with the highest percentage of students 14 identified as limited English proficient, to school districts 15 that have large numbers of students determined to be limited 16 English proficient, or to school districts that have an 17 exceptional diversity of languages of origin spoken by students 18 determined to be limited English proficient. A grant may be 19 awarded for a period of up to three years. The department 20 and each school district receiving a grant shall enter into 21 a performance agreement, which shall be renewed annually, 22 that identifies clear literacy achievement goals for limited 23 English proficient students enrolled in the school district 24 and includes an accountability system to measure student 25 performance and evaluate program effectiveness to ensure that 26 program goals are met. School districts may expend grant 27 moneys for professional development for professional staff 28 providing instructional services to limited English proficient 29 students. 30 Sec. 12. Section 257.31, subsection 6, paragraph a, Code 31 2014, as amended by 2014 Iowa Acts, Senate File 2230, section 32 7, is amended to read as follows: 33 a. The committee shall increase establish a modified 34 supplemental amount for a district when the district submits 35 -26- SF 2347 (3) 85 kh/tm/jh 26/ 37
S.F. 2347 evidence that it requires additional funding for removal, 1 management, or abatement of environmental hazards due to a 2 state or federal requirement. Environmental hazards shall 3 include but are not limited to the presence of asbestos, radon, 4 or the presence of any other hazardous material dangerous to 5 health and safety. 6 Sec. 13. Section 257.41, subsection 1, Code 2014, as amended 7 by 2014 Iowa Acts, Senate File 2230, section 11, is amended to 8 read as follows: 9 1. Budget. The budget of an approved program for returning 10 dropouts and dropout prevention for a school district, 11 after subtracting funds received from other sources for that 12 purpose, shall be funded annually on a basis of one-fourth 13 or more from the district cost of the school district and up 14 to three-fourths by an increase in through establishment of 15 a modified supplemental amount as defined in section 257.8 . 16 Annually, the department of management shall establish a 17 modified supplemental amount for each such school district 18 equal to the difference between the approved budget for the 19 program for returning dropouts and dropout prevention for that 20 district and the sum of the amount funded from the district 21 cost of the school district plus funds received from other 22 sources. 23 Sec. 14. Section 261.92, subsection 1, Code 2014, as amended 24 by 2014 Iowa Acts, Senate File 2230, section 17, is amended to 25 read as follows: 26 1. “Accredited higher education institution” means a public 27 institution of higher learning located in Iowa which is 28 accredited by the higher learning commission, or an institution 29 of higher learning located in Iowa which is operated privately 30 and not controlled or administered by any state agency or any 31 subdivision of the state, and which promotes equal opportunity 32 and affirmative action efforts in the recruitment, appointment, 33 assignment, and advancement of personnel at the institution 34 and provides information regarding such efforts to the college 35 -27- SF 2347 (3) 85 kh/tm/jh 27/ 37
S.F. 2347 student aid commission upon request. 1 Sec. 15. Section 261.110, subsection 4, Code 2014, is 2 amended to read as follows: 3 4. A selected applicant who meets all of the eligibility 4 requirements of this section shall be eligible for a teach Iowa 5 scholar grant for each year of full-time employment completed 6 in this state as a teacher for a school district, charter 7 school, area education agency, or accredited nonpublic school. 8 A teach Iowa scholar grant shall not exceed four thousand 9 dollars per year per recipient. Grants awarded under this 10 section shall not exceed a total of twenty thousand dollars per 11 recipient over a five-year period. If a selected applicant has 12 received a federally guaranteed Stafford loan under the federal 13 family education loan program or the federal direct loan 14 program, a federal direct plus loan, or a federal Perkins loan, 15 the selected applicant may elect to have the commission make 16 payment under the program directly to the selected applicant’s 17 student loan holder. 18 Sec. 16. Section 261.113, subsection 3, paragraph d, Code 19 2014, as amended by 2014 Iowa Acts, Senate File 2257, section 20 8, is amended to read as follows: 21 d. Within nine months of graduating from the residency 22 program and receiving a permanent license in accordance with 23 paragraph “b” , engage in the full-time practice of medicine 24 and surgery or osteopathic medicine and surgery specializing 25 in family medicine, pediatrics, psychiatry, internal medicine, 26 or general surgery for a period of five consecutive years in 27 the service commitment area specified under subsection 6 , 28 unless the loan repayment recipient receives a waiver from the 29 commission to complete the months years of practice required 30 under the agreement in another service commitment area pursuant 31 to subsection 6 . 32 Sec. 17. Section 261.113, subsection 6, Code 2014, is 33 amended to read as follows: 34 6. Selection of service commitment area. A loan repayment 35 -28- SF 2347 (3) 85 kh/tm/jh 28/ 37
S.F. 2347 recipient shall notify the commission of the recipient’s 1 service commitment area prior to beginning practice in the area 2 in accordance with subsection 3 , paragraph “d” . The commission 3 may waive the requirement that the loan repayment recipient 4 practice in the same service commitment area for all sixty 5 months five years . 6 Sec. 18. Section 261.114, subsection 3, paragraph b, Code 7 2014, as amended by 2014 Iowa Acts, Senate File 2257, section 8 12, is amended to read as follows: 9 b. Within nine months of receiving a degree and obtaining 10 a license in accordance with paragraph “a” , engage in the 11 full-time practice as an advanced registered nurse practitioner 12 or physician assistant for a period of five consecutive years 13 in the service commitment area specified under subsection 6 , 14 unless the loan repayment recipient receives a waiver from the 15 commission to complete the months years of practice required 16 under the agreement in another service commitment area pursuant 17 to subsection 6 . 18 Sec. 19. Section 261.114, subsection 6, Code 2014, is 19 amended to read as follows: 20 6. Selection of service commitment area. A loan repayment 21 recipient shall notify the commission of the recipient’s 22 service commitment area prior to beginning practice in the area 23 in accordance with subsection 3 . The commission may waive the 24 requirement that the loan repayment recipient practice in the 25 same service commitment area for all sixty months five years . 26 Sec. 20. Section 262.28, Code 2014, is amended to read as 27 follows: 28 262.28 Appropriations —— monthly installments —— transfers . 29 1. All appropriations made payable annually to each of the 30 institutions under the control of the board of regents shall be 31 paid in twelve equal monthly installments on the last day of 32 each month on order of said board. 33 2. In lieu of the consent and notification requirements of 34 section 8.39, the board may transfer moneys appropriated for 35 -29- SF 2347 (3) 85 kh/tm/jh 29/ 37
S.F. 2347 the purposes of the southwest Iowa regents resource center, the 1 northwest Iowa regents resource center, and the quad-cities 2 graduate studies center between such centers if the board 3 notifies, in writing, the general assembly and the legislative 4 services agency of the amount, the date, and the purpose of the 5 transfer. 6 Sec. 21. Section 272.10, subsection 4, Code 2014, is amended 7 to read as follows: 8 4. The board shall submit a detailed annual financial report 9 by January 1 to the chairpersons and ranking members of the 10 joint appropriations subcommittee on education general assembly 11 and the legislative services agency. 12 Sec. 22. Section 272.29, Code 2014, is amended to read as 13 follows: 14 272.29 Annual administrative rules review. 15 The executive director shall annually review the 16 administrative rules adopted pursuant to this chapter and 17 related state laws. The executive director shall submit 18 the executive director’s findings and recommendations in a 19 report every three years to the board and the chairpersons and 20 ranking members of the senate and house standing committees 21 on education and the joint appropriations subcommittee on 22 education general assembly by January 15. 23 Sec. 23. Section 273.3, subsection 11, Code 2014, is amended 24 to read as follows: 25 11. Employ personnel to carry out the functions of the 26 area education agency which shall include the employment of an 27 administrator who shall possess a license issued under chapter 28 272 . The administrator shall be employed pursuant to section 29 279.20 and sections 279.23 , 279.24 , and 279.25 . The salary for 30 an area education agency administrator shall be established 31 by the board based upon the previous experience and education 32 of the administrator. Section 279.13 applies to the area 33 education agency board and to all teachers employed by the area 34 education agency. Sections 279.23 , 279.24 , and 279.25 apply to 35 -30- SF 2347 (3) 85 kh/tm/jh 30/ 37
S.F. 2347 the area education board and to all administrators employed by 1 the area education agency. Section 279.69 applies to the area 2 education agency board and employees of the board, including 3 part-time, substitute, or contract employees, who provide 4 services to a school or school district. 5 Sec. 24. Section 280.4, subsection 3, paragraph b, Code 6 2014, is amended to read as follows: 7 b. For students first determined to be limited English 8 proficient for a budget year beginning on or after July 1, 9 2010, the additional weighting provided under paragraph “a” 10 shall be included in the weighted enrollment of the school 11 district of residence for a cumulative period of time not 12 exceeding five years beginning with the budget year for 13 which the student was first determined to be limited English 14 proficient. The five years of eligibility for the additional 15 weighting need not be consecutive and a student’s eligibility 16 for the additional weighting is transferable to another 17 district of residence. 18 Sec. 25. Section 284.13, subsection 1, paragraphs a, b, c, 19 d, and f, Code 2014, are amended to read as follows: 20 a. For the fiscal year beginning July 1, 2013 2014 , and 21 ending June 30, 2014 2015 , to the department of education, the 22 amount of eight hundred forty-six thousand two hundred fifty 23 dollars for the issuance of national board certification awards 24 in accordance with section 256.44 . Of the amount allocated 25 under this paragraph, not less than eighty-five thousand 26 dollars shall be used to administer the ambassador to education 27 position in accordance with section 256.45 . 28 b. For the fiscal year beginning July 1, 2013 2014 , and 29 ending June 30, 2014 2015 , an amount up to three four million 30 five hundred thirty-seven twenty-one thousand eight hundred 31 seventy-five dollars for first-year and second-year beginning 32 teachers, to the department of education for distribution to 33 school districts and area education agencies for purposes 34 of the beginning teacher mentoring and induction programs. 35 -31- SF 2347 (3) 85 kh/tm/jh 31/ 37
S.F. 2347 A school district or area education agency shall receive 1 one thousand three hundred dollars per beginning teacher 2 participating in the program. If the funds appropriated for 3 the program are insufficient to pay mentors, school districts, 4 and area education agencies as provided in this paragraph, 5 the department shall prorate the amount distributed to 6 school districts and area education agencies based upon the 7 amount appropriated. Moneys received by a school district 8 or area education agency pursuant to this paragraph shall be 9 expended to provide each mentor with an award of five hundred 10 dollars per semester, at a minimum, for participation in 11 the school district’s or area education agency’s beginning 12 teacher mentoring and induction program; to implement the 13 plan; and to pay any applicable costs of the employer’s share 14 of contributions to federal social security and the Iowa 15 public employees’ retirement system or a pension and annuity 16 retirement system established under chapter 294 , for such 17 amounts paid by the district or area education agency. 18 c. For the fiscal year beginning July 1, 2013 2014 , and 19 ending June 30, 2014 2015 , up to seven hundred eighty-six 20 thousand eight hundred sixteen dollars to the department for 21 purposes of implementing the professional development program 22 requirements of section 284.6 , assistance in developing model 23 evidence for teacher quality committees established pursuant to 24 section 284.4, subsection 1 , paragraph “c” , and the evaluator 25 training program in section 284.10 . A portion of the funds 26 allocated to the department for purposes of this paragraph may 27 be used by the department for administrative purposes and for 28 not more than four full-time equivalent positions. 29 d. For the fiscal year beginning July 1, 2013 2014 , and 30 ending June 30, 2014 2015 , an amount up to one million one 31 hundred thirty-six thousand four hundred ten dollars to 32 the department for the establishment of teacher development 33 academies in accordance with section 284.6, subsection 10 . A 34 portion of the funds allocated to the department for purposes 35 -32- SF 2347 (3) 85 kh/tm/jh 32/ 37
S.F. 2347 of this paragraph may be used for administrative purposes. 1 f. For the fiscal year beginning July 1, 2014 2015 , 2 and for each subsequent fiscal year, to the department of 3 education, ten million dollars for purposes of implementing 4 the supplemental assistance for high-need schools provisions 5 of section 284.11 . Annually, of the moneys allocated to 6 the department for purposes of this paragraph, up to one 7 hundred thousand dollars may be used by the department for 8 administrative purposes and for not more than one full-time 9 equivalent position. 10 Sec. 26. Section 284.13, subsection 1, paragraph e, 11 subparagraph (2), subparagraph division (a), Code 2014, is 12 amended to read as follows: 13 (a) For the initial school year for which a school district 14 receives department approval for and implements a framework or 15 comparable system in accordance with section 284.15 , teacher 16 leadership supplement foundation aid payable to that school 17 district shall be paid from the allocation made in subparagraph 18 (1) for that school year. For that school year, the teacher 19 leadership supplement foundation aid payable to the school 20 district is the product of the teacher leadership district 21 cost per pupil for the school year multiplied by the school 22 district’s budget enrollment. The board of directors of the 23 district of residence shall pay to the receiving district any 24 moneys received for a pupil under subparagraph (1) if the pupil 25 is participating in open enrollment under section 282.18 and 26 both the district of residence and the receiving district are 27 receiving an allocation under subparagraph (1). 28 Sec. 27. Section 284.13, subsection 1, paragraph e, 29 subparagraph (3), Code 2014, is amended to read as follows: 30 (3) Of the moneys allocated to the department for the 31 purposes of this paragraph “e” , for each fiscal year included in 32 subparagraph (1), not more than seven hundred thousand dollars 33 shall be used by the department for the development of a 34 delivery system , in collaboration with area education agencies, 35 -33- SF 2347 (3) 85 kh/tm/jh 33/ 37
S.F. 2347 to assist in implementing the career paths and leadership 1 roles considered pursuant to sections 284.15 , 284.16 , and 2 284.17 , including but not limited to planning grants to school 3 districts and area education agencies, technical assistance 4 for the department, technical assistance for districts and 5 area education agencies, training and staff development, 6 and the contracting of external expertise and services. In 7 using moneys allocated for purposes of this subparagraph (3), 8 the department shall give priority to school districts with 9 certified enrollments of fewer than six hundred students. A 10 portion of the moneys allocated annually to the department 11 for purposes of this subparagraph (3) may be used by the 12 department for administrative purposes and for not more than 13 five full-time equivalent positions. 14 Sec. 28. Section 284A.2, subsection 1, Code 2014, is amended 15 to read as follows: 16 1. “Administrator” means an individual holding a 17 professional administrator license issued under chapter 272 18 who is employed in a school district administrative position 19 by a school district or area education agency pursuant to 20 a contract issued by a board of directors under section 21 279.23 and is engaged in instructional leadership. An 22 administrator may be employed in both an administrative and a 23 nonadministrative position by a board of directors and shall 24 be considered a part-time administrator for the portion of 25 time that the individual is employed in an administrative 26 position. “Administrator” does not include assistant principals 27 or assistant superintendents. 28 DIVISION II 29 WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS FY 2014-2015 30 Sec. 29. 2013 Iowa Acts, chapter 141, section 54, 31 subsections 1 and 4, are amended to read as follows: 32 1. The criteria shall be 25 based on need for instruction in English as a second language 26 in the region served by each community college as determined by 27 factors including data from the latest federal decennial census 28 and outreach efforts to determine regional needs. 29 (4) From the moneys appropriated in this paragraph, 30 $105,000 $210,000 shall be transferred to the department of 31 human services for purposes of administering a pilot project 32 to provide access to international resources to Iowans and new 33 Iowans to provide economic and leadership development resulting 34 in Iowa being a more inclusive and welcoming place to live, 35 -35- SF 2347 (3) 85 kh/tm/jh 35/ 37
