1 | AMENDMENT TO HOUSE BILL 2301
| ||||||
2 | AMENDMENT NO. ______. Amend House Bill 2301 on page 3 by | ||||||
3 | inserting immediately below line 9 the following:
| ||||||
4 | "Section 7. The Coal Mining Act is amended by changing | ||||||
5 | Sections 8.02 and 8.03 as follows:
| ||||||
6 | (225 ILCS 705/8.02) (from Ch. 96 1/2, par. 802)
| ||||||
7 | Sec. 8.02.
There is created in the Department of Natural | ||||||
8 | Resources, Office
of Mines and Minerals, a Miners' Examining | ||||||
9 | Board which shall consist of 4
four miners' examining officers | ||||||
10 | to be appointed by the Governor, 2 of which must be from a | ||||||
11 | labor organization recognized under the National Labor | ||||||
12 | Relations Act, for a term of
2 years and until their successors | ||||||
13 | are appointed and qualified. Terms of
office shall commence on | ||||||
14 | the third Monday in January in each odd-numbered year.
Three of | ||||||
15 | such officers shall constitute a quorum.

16 | This amendatory Act of 1995 does not affect the terms of |
| |||||||
| |||||||
1 | members of the
Miners' Examining Board holding office on the | ||||||
2 | effective date of this amendatory
Act of 1995.
| ||||||
3 | A complete record of the proceedings and acts of the | ||||||
4 | Miners'
Examining Board shall be kept and preserved. Said | ||||||
5 | officers shall hold no
other lucrative office or employment | ||||||
6 | under the government of the United
States, State of Illinois, | ||||||
7 | or any political division thereof or any
municipal corporation | ||||||
8 | therein and each such officer before entering upon
the duties | ||||||
9 | of his office shall subscribe and take the oath prescribed by
| ||||||
10 | the Constitution of this State, and shall before entering upon | ||||||
11 | the duties
of his office give a bond with sufficient surety to | ||||||
12 | be approved by the
Governor, payable to the People of the State | ||||||
13 | of Illinois in the penal sum
of $5,000, conditioned for the | ||||||
14 | faithful discharge of the duties of office
and the delivery of | ||||||
15 | all records, books, moneys, and other property
pertaining to | ||||||
16 | his successor in office, which said bond shall be deposited
in | ||||||
17 | the office of the Secretary of State. Vacancies shall be filled | ||||||
18 | by
appointment as provided herein for the balance of the | ||||||
19 | unexpired term.

has not had at least 5 years' practical and | ||||||

2 | appointment; except that a miners' examining officer may be | ||||||
3 | appointed to
succeed himself .
