Bill Title: Amends the Park District Code. Provides that whenever any member of the governing board of any park district is convicted in any court located in the United States of any infamous crime, bribery, perjury, or other felony (rather than is convicted of any infamous crime), that office may be declared vacant. Effective immediately.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Park District Code is amended by changing
5Section 2-25 as follows:
6 (70 ILCS 1205/2-25) (from Ch. 105, par. 2-25)
7 Sec. 2-25. Vacancies. Whenever any member of the governing
8board of any park district (i) dies, (ii) resigns, (iii)
9becomes under legal disability, (iv) ceases to be a legal voter
10in the district, (v) is convicted in any court located in the
11United States of any infamous crime, bribery, perjury, or other
12felony (vi) refuses or neglects to take his or her oath of
13office, (vii) neglects to perform the duties of his or her
14office or attend meetings of the board for the length of time
15as the board fixes by ordinance, or (viii) for any other reason
16specified by law, that office may be declared vacant. Vacancies
17shall be filled by appointment by a majority of the remaining
18members of the board. Any person so appointed shall hold his or
19her office until the next regular election for this office, at
20which a member shall be elected to fill the vacancy for the
21unexpired term, subject to the following conditions:
22 (1) If the vacancy occurs with less than 28 months
23 remaining in the term, the person appointed to fill the

1 vacancy shall hold his or her office until the expiration
2 of the term for which he or she has been appointed, and no
3 election to fill the vacancy shall be held.
4 (2) If the vacancy occurs with more than 28 months left
5 in the term, but less than 123 days before the next
6 regularly scheduled election for this office, the person
7 appointed to fill the vacancy shall hold his or her office
8 until the second regularly scheduled election for the
9 office following the appointment, at which a member shall
10 be elected to fill the vacancy for the unexpired term.

12 Section 99. Effective date. This Act takes effect upon
13becoming law.
