Bill Title: Amends the Recreational Trails of Illinois Act. Provides that the fees for public access stickers shall be deposited as follows: (1) $5 from the sale of each off-highway vehicle trails public access sticker shall be deposited into the Tick Research, Education, and Evaluation (TREE) Fund, which is created as a special fund in the State treasury. Provides that moneys deposited in the Tick Research, Education, and Evaluation (TREE) Fund shall be paid as grants for the ordinary and contingent expenses associated with tick research, education, and evaluation; and (2) the remainder of the fees for public access stickers shall be deposited into the Off-Highway Vehicle Trails Fund to be used for improvements to Illinois State Parks (rather than all fees for public access stickers being deposited into the Off-Highway Vehicle Trails Fund). Amends the State Finance Act to make conforming changes.

520 ILCS 5/1.28 from Ch. 61, par. 1.28

Amends the Wildlife Code. Provides that fines and fees deposited into the Wildlife and Fish Fund may be used to increase public safety through grants to not-for-profit entities for tick research, education, and evaluation. Effective immediately.

1 AN ACT concerning wildlife.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Wildlife Code is amended by changing
5Section 1.28 as follows:
6 (520 ILCS 5/1.28) (from Ch. 61, par. 1.28)
7 Sec. 1.28. Fees and fines; deposit in funds. All fees,
8fines, including bond forfeitures, income of whatsoever kind
9or nature derived from hunting and fishing activities on lands
10or waters or both under the jurisdiction or control of the
11Department, and all penalties collected under this Act shall
12be deposited in the State Treasury and shall be set apart in a
13special fund to be known as the "Wildlife and Fish Fund";
14except that fees derived solely from the sale of salmon
15stamps, income from art contests for the salmon stamp,
16including income from the sale of reprints, and gifts,
17donations, grants and bequests of money for the conservation
18and propagation of salmon shall be deposited in the State
19Treasury and set apart in the special fund to be known as the
20"Salmon Fund"; and except that fees derived solely from the
21sale of state migratory waterfowl stamps, and gifts,
22donations, grants and bequests of money for the conservation
23and propagation of waterfowl shall be deposited in the special

1fund to be known as the "State Migratory Waterfowl Stamp
2Fund"; and except that, of fees derived solely from the sale of
3State Habitat Stamps, 64% shall be deposited into the Illinois
4Habitat Fund, 30% into the State Pheasant Fund, and 6% into the
5State Furbearer Fund. Income generated from the sale of
6artwork associated with the State Habitat Stamps shall be
7deposited into the Illinois Habitat Fund. All interest that
8accrues from monies deposited into the Wildlife and Fish Fund,
9the Salmon Fund, the State Migratory Waterfowl Stamp Fund, the
10State Furbearer Fund, the State Pheasant Fund, and the
11Illinois Habitat Fund shall be deposited into those funds,
12respectively. Appropriations from the "Wildlife and Fish Fund"
13shall be made only to the Department for the carrying out of
14the powers and functions vested by law in the Department for
15the administration and management of fish and wildlife
16resources of this State for such activities as the purchase of
17land for fish hatcheries, wildlife refuges, preserves and
18public shooting and fishing grounds; the purchase and
19distribution of wild birds, the eggs of wild birds, and wild
20mammals for rescuing, restoring and distributing fish; the
21maintenance of wildlife refuges, or preserves, public shooting
22grounds, public fishing grounds and fish hatcheries; and the
23feeding and care of wild birds, wild animals and fish; and the
24increasing of public safety by making grants to not-for-profit
25entities for tick research, education, and evaluation.

1 Section 99. Effective date. This Act takes effect upon
