AMENDMENT TO SENATE BILL 171
2 AMENDMENT NO. ______. Amend Senate Bill 171 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Township Code is amended by adding the
5heading of Article 27 and Sections 27-5, 27-10, and 27-15 as
6follows:

ARTICLE 27. DISCONTINUANCE OF THE OFFICE OF HIGHWAY

COMMISSIONER
10 (60 ILCS 1/27-5 new)
11 Sec. 27-5. Referendum to discontinue the office of Highway
12Commissioner. By petition of at least 10% of the registered
13voters of a township, as determined on the date registration
14closed before the regular election next preceding the last day
15on which the petition may be filed, of a county that has

1adopted township organization, or upon ordinance or resolution
2adopted by the township board, the township board shall certify
3and cause to be submitted to the voters of the township, at the
4next election, the question of the continuance of the office of
5Highway Commissioner. A signature on a petition shall not be
6valid or counted in considering the petition unless the form
7requirements are complied with and the date of each signature
8is less than 90 days before the last day for filing the
9petition. The statement of the person who circulates the
10petition must include an attestation (i) indicating the dates
11on which that sheet was circulated, (ii) indicating the first
12and last date on which that sheet was circulated, or (iii)
13certifying that none of the signatures on the sheet was signed
14more than 90 days before the last day for filing the petition.
15The petition shall be treated and the proposition certified in
16the manner provided by the general election law.
17 The proposition shall be in substantially the following
18form:
19 Shall the office of Highway Commissioner be continued
20 in (name of township)?
21 The votes shall be recorded as "Yes" or "No".

23 Sec. 27-10. Cessation of offices in a township. If a
24majority of the votes of the township cast on the question of
25the continuance of the office of Highway Commissioner at the

1election are against the proposed option for continuance, then
2the office of Highway Commissioner shall cease in the township
3at the end of the current term of office. If the office of the
4Highway Commissioner ceases, then the county superintendent of
5highways or the county engineer, as applicable, shall assume
6the duties of Highway Commissioner under the Illinois Highway
7Code.

9 Sec. 27-15. Township assets. If the office of Highway
10Commissioner is discontinued, then the assets of that office
11shall be appraised and distributed equally between the county
12and the township.
13 Section 10. The Illinois Highway Code is amended by adding
14Section 5-205.10 as follows:

16 Sec. 5-205.10. Cessation of township Highway Commissioner.
17If the office of Highway Commissioner ceases as provided in
18Article 27 of the Township Code, then the county superintendent
19of highways or the county engineer, as applicable, shall assume
20the duties of Highway Commissioner under this Code.
21 Section 99. Effective date. This Act takes effect upon
22becoming law.".
