AMENDMENT TO SENATE BILL 2998
2 AMENDMENT NO. ______. Amend Senate Bill 2998 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Police Training Act is amended by
5changing Section 9 as follows:
6 (50 ILCS 705/9) (from Ch. 85, par. 509)
7 Sec. 9. A special fund is hereby established in the State
8Treasury to be known as "The Traffic and Criminal Conviction
9Surcharge Fund" and shall be financed as provided in Section
109.1 of this Act and Section 5-9-1 of the "Unified Code of
11Corrections", unless the fines, costs or additional amounts
12imposed are subject to disbursement by the circuit clerk under
13Section 27.5 of the Clerks of Courts Act. Moneys in this Fund
14shall be expended as follows:
15 (a) 75% of the total amount deposited in the Fund shall
16 be used by the Illinois Law Enforcement Training Standards

1 Board as follows:
2 (1) A portion of the total amount deposited in the
3 Fund may be used, as appropriated by the General
4 Assembly, for the ordinary and contingent expenses of
5 the Illinois Law Enforcement Training Standards Board;
6 (2) A portion of the total amount deposited in the
7 Fund shall be appropriated for the reimbursement of
8 local governmental agencies participating in training
9 programs certified by the Board, in an amount equaling
10 1/2 of the total sum paid by such agencies during the
11 State's previous fiscal year for mandated training for
12 probationary police officers or probationary county
13 corrections officers and for optional advanced and
14 specialized law enforcement or county corrections
15 training. These reimbursements may include the costs
16 for tuition at training schools, the salaries of
17 trainees while in schools, and the necessary travel and
18 room and board expenses for each trainee. If the
19 appropriations under this paragraph (2) are not
20 sufficient to fully reimburse the participating local
21 governmental agencies, the available funds shall be
22 apportioned among such agencies, with priority first
23 given to repayment of the costs of mandatory training
24 given to law enforcement officer or county corrections
25 officer recruits, then to repayment of costs of
26 advanced or specialized training for permanent police

1 officers or permanent county corrections officers;
2 (3) A portion of the total amount deposited in the
3 Fund shall may be used to fund the "Intergovernmental
4 Law Enforcement Officer's In-Service Training Act",
5 veto overridden October 29, 1981, as now or hereafter
6 amended, at a rate and method to be determined by the
7 board;
8 (4) (Blank); A portion of the Fund also may be used
9 by the Illinois Department of State Police for expenses
10 incurred in the training of employees from any State,
11 county or municipal agency whose function includes
12 enforcement of criminal or traffic law;
13 (5) A portion of the Fund may be used by the Board
14 to fund grant-in-aid programs and services for the
15 training of employees from any county or municipal
16 agency whose functions include corrections or the
17 enforcement of criminal or traffic law; .
18 (b) 25% of the Fund also shall be used by the Illinois
19 Department of State Police for expenses incurred in the
20 training of employees from any State, county or municipal
21 agency whose function includes enforcement of criminal or
22 traffic law.
23 All payments from The Traffic and Criminal Conviction
24Surcharge Fund shall be made each year from moneys appropriated
25for the purposes specified in this Section. No more than 50% of
26any appropriation under this Act shall be spent in any city

1having a population of more than 500,000. The State Comptroller
2and the State Treasurer shall from time to time, at the
3direction of the Governor, transfer from The Traffic and
4Criminal Conviction Surcharge Fund to the General Revenue Fund
5in the State Treasury such amounts as the Governor determines
6are in excess of the amounts required to meet the obligations
7of The Traffic and Criminal Conviction Surcharge Fund.

9 Section 99. Effective date. This Act takes effect upon
