SYNOPSIS AS INTRODUCED:
415 ILCS 5/9.18 new

Amends the Environmental Protection Act. Provides that on and after January 1, 2022, a person may not operate or sell at retail a gas-powered leaf blower in the State. Provides that a person who violates the amendatory Act's provisions shall be subject to a civil penalty not to exceed $500. Effective immediately.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5adding Section 9.18 as follows:
6 (415 ILCS 5/9.18 new)
7 Sec. 9.18. Gas-powered leaf blower ban.
8 (a) The General Assembly finds that:
9 (1) gas-powered leaf blowers are detrimental to the
10 health of the citizens of the State of Illinois and the
11 quality of the environment;
12 (2) two-stroke and four-stroke engines used in
13 gas-powered leaf blowers emit exceedingly high rates of
14 pollutants, including, but not limited to, carbon
15 monoxide, nitrous oxides, and hydrocarbons;
16 (3) the chemical pollutants that gas-powered leaf
17 blowers emit can contribute to smog formation and acid
18 rain;
19 (4) gas-powered leaf blowers generate noise at a
20 decibel level capable of causing hearing loss in a short
21 amount of time;
22 (5) gas-powered leaf blowers send dust and other small
23 particles into the air for considerable distances,

1 including, but not limited to, animal feces, trace
2 quantities of heavy metals such as lead, and allergens such
3 as pollen and mold.
4 (b) In this Section, "gas-powered leaf blower" means a leaf
5blower that has a two-stroke or four-stroke engine using
6gasoline or a gasoline and oil blend as fuel.
7 (c) On and after January 1, 2022, a person may not operate
8a gas-powered leaf blower in the State of Illinois.
9 (d) On and after January 1, 2022, a person may not sell at
10retail a gas-powered leaf blower in the State of Illinois.
11 (e) Any person who violates this Section shall be subject
12to a civil penalty not to exceed $500.
13 Section 99. Effective date. This Act takes effect upon
14becoming law.
