Synopsis: School safety. Provides that a student may be disciplined for committing a delinquent, criminal, or tortious act against another student or a teacher that violates school discipline rules and that is committed while the student is on or off school grounds, including during periods when the student is not attending classes or school functions.

Effective: July 1, 2013.

HOUSE BILL No. 1015



    A BILL FOR AN ACT to amend the Indiana Code concerning education.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 20-33-8-15; (13)IN1015.1.1. -->     SECTION 1. IC 20-33-8-15, AS ADDED BY P.L.1-2005, SECTION 17, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 15. In addition to the grounds specified in section 14 of this chapter, a student may be suspended or expelled subject to school discipline, including suspension and expulsion, for engaging in unlawful activity a delinquent, criminal, or tortious act committed by the student against another student or a teacher on or off school grounds if:
        (1) the unlawful activity delinquent, criminal, or tortious act violates school rules adopted under section 12 of this chapter and may reasonably be considered to be an a substantial interference with school purposes or an educational function; or
        (2) the student's removal is necessary to restore order or protect persons on school property;
including an unlawful activity a delinquent, criminal, or tortious act committed by the student against another student or a teacher that violates school rules adopted under section 12 of this chapter and

that is committed during weekends, holidays, other school breaks, and the summer period when a student may not be attending classes or other school functions.
