HOUSE BILL NO. 6138

Love, Cynthia Neeley, Bolden, Cynthia Johnson, Kuppa, Coleman, Witwer, Pohutsky, Stone, Hood, Koleszar, Ellison, Sabo, Hertel, Sowerby, Tate, Clemente, Haadsma, Gay-Dagnogo, Yancey, Garrett, Rabhi, Brenda Carter, Tyrone Carter, Peterson and Inman and referred to the Committee on Health Policy.

A bill to require long-term care facilities to report certain data; to prescribe civil sanctions; to provide for the powers and duties of certain state officers and entities; and to allow for the promulgation of rules.

the people of the state of michigan enact:

Sec. 1. As used in this act:

(a) "Adult foster care facility" means that term as defined in section 3 of the adult foster care facility licensing act, 1979 PA 218, MCL 400.703.

(b) "COVID-19" means severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2).

(c) "Department" means the department of health and human services.

(d) "Director" means the director of the department or his or her designee.

(e) "Home for the aged" means that term as defined in section 20106 of the public health code, 1978 PA 368, MCL 333.20106.

(f) "Long-term care facility" means an assisted living facility, adult foster care facility, home for the aged, or nursing home.

(g) "Nursing home" means that term as defined in section 20109 of the public health code, 1978 PA 368, MCL 333.20109.

Sec. 3. A long-term care facility shall submit a daily report to the department containing the data required under section 5 to assist the department in preventing the spread of COVID-19. The report required under this section must be submitted in a form and manner required by the department.

Sec. 5. The report required under section 3 must include all of the following data:

(a) The cumulative number of COVID-19 positive cases among residents and staff.

(b) The cumulative number of COVID-19 positive cases among residents and staff that are asymptomatic and the cumulative number of COVID-19 positive cases that are symptomatic.

(c) The cumulative number of COVID-19 deaths among residents and staff.

(d) The cumulative number of COVID-19 recoveries among residents and staff.

(e) The county where the long-term care facility is located.

(f) The type of long-term care facility.

(g) The number of residents.

(h) The number of staff and staff shortages.

(i) The cumulative number of COVID-19 tests conducted on residents.

(j) The cumulative number of COVID-19 tests conducted on staff.

(k) The age, ethnicity, race, and gender of each resident and staff member.

(l) The number of isolation beds.

(m) The number of transfers of residents to hospitals, regional hubs, or other facilities.

(n) The amount of medical supplies necessary to respond to COVID-19. As used in this subdivision, "medical supplies" includes, but is not limited to, gloves, cloth face coverings, sterile gloves, surgical masks, nonsurgical masks, and isolation gowns.

(o) Any other data considered necessary by the department.

Sec. 7. The department shall compile the information reported to the department under section 3 and submit the report to the house and senate standing committees on health policy each week until the COVID-19 pandemic ceases to constitute a state of emergency or disaster as declared by the governor.

Sec. 9. A person who violates this act may be ordered to pay a civil fine of not more than $500.00 for each violation or day that the violation continues.

Sec. 11. The department may promulgate rules to implement this act under the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.
