HOUSE BILL No. 6494

     A bill to amend 2004 PA 47, entitled

 

"Medical records access act,"

 

by amending section 11 (MCL 333.26271).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 11. (1) This Except as otherwise provided in subsection

 

(2), this act does not apply to copies of medical records provided

 

to a third party payer, insurer as defined in section 106 of the

 

insurance code of 1956, 1956 PA 218, MCL 500.106, or self-funded

 

plan.

 

     (2) This act applies to copies of medical records provided to

 

a life insurance underwriter acting on behalf of a life insurer if

 

the life insurance underwriter is an authorized representative.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
