1.1A bill for an act
1.2relating to state government; veterans; providing noncompetitive appointment of
1.3certain disabled veterans;proposing coding for new law in Minnesota Statutes,
1.4chapter 43A.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [43A.111] NONCOMPETITIVE APPOINTMENT OF CERTAIN
1.7DISABLED VETERANS.
1.8(a) Whenever a vacancy occurs in a position in the classified service, the appointing
1.9authority may appoint a disabled veteran, on a noncompetitive basis, if all of the following
1.10occur:
1.11(1) the disabled veteran has served in the United States armed forces and is included
1.12on a United States armed forces permanent disability list with a disability rating of at
1.13least 30 percent or the disabled veteran has been rated by the United States Department
1.14of Veterans Affairs as having a compensable service-connected disability of at least 30
1.15percent;
1.16(2) the disabled veteran presents to the appointing authority written documentation
1.17from an appropriate department of the federal government certifying the existence and
1.18extent of disability. The certification must have been issued by the appropriate department
1.19of the federal government within the year preceding appointment; and
1.20(3) the appointing authority determines that the disabled veteran meets the minimum
1.21qualifications for the vacant position.
1.22(b) If an appointing authority elects to appoint a disabled veteran to a vacant position
1.23on a noncompetitive basis under paragraph (a), an appointing authority is not required to
1.24interview any other person.
