AN ACT

To amend chapter 407, RSMo, by adding thereto one new section relating to rental companies.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.728, to read as follows:

            407.728. Any rental company in the business of renting a passenger vehicle or motorcycle doing business in this state using electronic surveillance technology to track a renter for the purpose of imposing fines or surcharges relating to the renter's use of a rental vehicle or motorcycle shall provide the renter with a separate rental agreement contract prior to issuing the rental vehicle or motorcycle stating that such vehicle or motorcycle contains electronic surveillance technology, that such technology will be used to track the renter's operation of the rental vehicle or motorcycle, and that the rental company may impose certain fines and surcharges for improper operation of the rental vehicle or motorcycle. All rental companies in the business of renting passenger vehicles or motorcycles doing business in this state shall post signage in or upon the rental vehicle or motorcycle, within plain site of the operator, that such vehicle or motorcycle has electronic surveillance technology for the purpose of tracking the renter's operation of the rental vehicle or motorcycle and that the rental company may impose fines and surcharges for improper operation of the rental vehicle or motorcycle.
