Senate Bill 2673

AN ACT TO AMEND SECTION 79-11-511, MISSISSIPPI CODE OF 1972, TO CLARIFY SERVICE OF PROCESS ON ENTITIES SOLICITING CHARITABLE DONATIONS IN THIS STATE; TO REQUIRE DESIGNATION OF A REGISTERED AGENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 79-11-511, Mississippi Code of 1972, is amended as follows:

     79-11-511.  Any charitable organization, person, professional fund-raiser, fund-raising counsel or professional solicitor, which or who solicits contributions in this state, * * *but does not maintain an office within the state, shall be subject to service of process by designating a registered agent under Section 79-35-1 et seq., upon which process may be served in the State of Mississippi, or if no designation has been made and process cannot be served, then service of process shall be upon the Secretary of State of Mississippi.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2018.
