A BILL TO BE ENTITLED

AN ACT TO PROHIBIT THE TRANSFER OF FUNDS ALLOCATED FOR SCHOOL NURSES, SCHOOL PSYCHOLOGISTS, SCHOOL SOCIAL WORKERS, AND SCHOOL RESOURCE OFFICERS UNLESS THEY ARE SENT TO ANOTHER local board of education FOR THE SAME PURPOSE.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 115C‑105.25(b) reads as rewritten:

"(b)      Subject to the following limitations, local boards of education may transfer and may approve transfers of funds between funding allotment categories:

(3c)      No funds shall be transferred out of the instructional support allotment category except as provided in subdivision (5d) of this subsection.

(3d)     No funds shall be transferred out of the school resource officers allotment category except as provided in subdivision (5e) of this subsection.

(5b)      Except as provided in subdivision (5a) of this subsection, positions allocated for classroom teachers and instructional support personnel may be converted to dollar equivalents for any purpose authorized by the policies of the State Board of Education. These positions shall be converted at the salary on the first step of the "A" Teachers Salary Schedule. Certified position allotments shall not be transferred to dollars to hire the same type of position.

(5d)     Positions allocated for instructional support personnel may be converted to dollar equivalents. These positions shall be converted at the statewide average salary for instructional support personnel. The converted funds may only be transferred between local school administrative units to fund additional instructional support positions.

(5e)      Funds allocated for school resource officers may only be transferred between local school administrative units to fund additional school resource officer positions.

SECTION 2.  The State Board of Education shall create a single allotment category for school resource officers from the at‑risk allotment. All funds allocated for school resource officers in the at‑risk allotment shall be moved to the newly created school resource officers allotment. Funds allocated for school resource officers through the school resource officer grant program established pursuant to Section 8.36 of S.L. 2013‑360 shall remain separate.

SECTION 3.  There is appropriated from the General Fund to the Department of Public Instruction for the 2018‑2019 fiscal year the sum of ten million dollars ($10,000,000) in recurring funds to the at‑risk allotment to supplement funds moved out of that allotment pursuant to Section 2 of this act.

SECTION 4.  This act is effective when it becomes law and applies beginning in the 2018‑2019 school year.
