STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT allowing citizens to record by audio or video a traffic stop by law enforcement officers.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Audio and Video Recording of Traffic Stop by Law Enforcement Permitted. Amend RSA 570-A:2, II by inserting after subparagraph (l) the following new subparagraph:

(m)(1) Any person to make an audio or video recording of a traffic stop by a law enforcement officer; provided that the act of recording does not interfere with the law enforcement officer’s ability to perform his or her official duties.

(2) Any audio or video recording of a law enforcement officer shall remain the property of its owner. In the event that such property is seized by law enforcement authorities, a copy of the audio or video recording shall be provided to the owner of the property within 30 days of the day the property is seized.

2 Effective Date. This act shall take effect July 1, 2015.
