STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to eligibility for agricultural plates.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Motor Vehicles; Words and Phrases Defined; Agricultural/Industrial Utility Vehicle.  Amend RSA 259:2-a to read as follows:

259:2-a  Agricultural/Industrial Utility Vehicle.  "Agricultural/industrial utility vehicle" shall mean a vehicle, including an off highway recreational vehicle, with 4 or 6 wheels, an internal combustion engine or electric motor, or both, but excluding a tractor, equipped in accordance with the provisions of RSA 261:41-a, III, that is capable of carrying not more than 6 occupants, has a load capacity of 1,500 pounds or less, and is in use for farming, agricultural, residential and private property maintenance and related business, or light industrial uses, and is limited to ways or portions of ways where such vehicles are allowed and having posted speed limits of 40 miles per hour or less, within a 10 mile radius from an entrance to land used by the farm or a 2 mile radius from the entrance to the light industrial complex or construction site, and subject to any other special conditions established by the government authority controlling the way.

2  Certificates of Title and Registration of Vehicles; Number Plates; Agricultural Plates.  Amend the introductory paragraph of RSA 261:82, I to read as follows:

I.  A truck, truck-tractor, tractor, agricultural/industrial utility vehicle, or cargo van shall qualify for agricultural registration rates and number plates and shall be driven with such registration only within a 20 mile radius from the main entrance to the farm upon which said vehicle is driven, and may be used for the following purposes:

3  New Subparagraph; Certificates of Title and Registration of Vehicles; Number Plates; Agricultural Plates.  Amend RSA 261:82, I by inserting after subparagraph (e) the following new subparagraph:

(f)  Residential and private property maintenance and related business.

4  Effective Date.  This act shall take effect 60 days after its passage.

*Pursuant to Part II, article 6-a of the New Hampshire constitution, any costs associated with the collection and administration of Highway Funds by the Department of Safety shall be deducted by the Department before such funds are credited to the Highway Fund as unrestricted revenue.

METHODOLOGY:

This bill adds certain agricultural/industrial utility vehicles to the list of vehicles that may qualify for agricultural registration rates and plates.  Vehicles registered with agricultural plates are required to pay one-third of the default registration rates.  Therefore, the expanded definition of vehicles qualifying for agricultural plates would likely decrease motor vehicle revenue.  Depending on how this bill changes registrations, local revenue would be impacted in two manners: 1) the local portion of revenue retained is $2 for agricultural plates and $5 for commercial plates, and 2) pursuant to RSA 235:23, local highway aid is at least 12 percent of highway revenue from the previous year, therefore a decrease in motor vehicle revenue would decrease local aid.  No method exists to determine how many vehicles would register under the provisions of this bill, so revenue will be impacted by an indeterminable amount.  

 

The Department of Safety estimates state expenditure would be impacted by $9,975 to reprogram the Department’s MAAP system to accommodate the changes in this bill.  Additionally, municipalities may incur an indeterminable cost modifying their software systems to reflect the changes in this bill.
