STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
AN ACT relative to paid details by personnel of the division of fire safety.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Duties of State Fire Marshal. Amend RSA 153:4-a by inserting after paragraph IV the following new paragraph:
V. The state fire marshal may detail full-time or part-time personnel of the division of fire safety for the purposes of law enforcement, code enforcement, hazardous materials safety, and public education services for public and private events and for extra duty functions to be performed outside regular business hours for which an outside entity will be reimbursing the department for the services. The commissioner of the department of safety shall establish a detail rate for such assignments. The rate shall include compensation for the assigned personnel plus reimbursement for the use of any vehicles or trailers, employee benefits, and related overhead expenses.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill allows for the state fire marshal to detail personnel for public or private events for the purpose of law enforcement, code enforcement, and other functions performed outside regular business hours. It is unknown how much detail work will be performed, or at what rate, but it is assumed that while state revenues and expenditures would both increase, it would be at a zero net cost to the state as all detail work would be reimbursed by the outside entities.
