SYNOPSIS
Requires a private seller of a used motor vehicle to request identification information from purchaser.

An Act concerning the sale of motor vehicles and supplementing Title 39 of the Revised Statues.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. For the purposes of this act:
"Buyer" includes any person buying, or attempting to buy a used motor vehicle;
"Seller" means any person, who is not a dealer as defined in R.S.39:10-2 and who sells, or attempts to sell a used motor vehicle; and
"Used motor vehicle" means every motor vehicle and motorized bicycle, except a nonconventional type motor vehicle, title to, or possession of, which has been transferred from the person who first acquired it from the manufacturer or dealer, and so used as to become what is commonly known as "secondhand" within the ordinary meaning thereof, and includes every motor vehicle and motorized bicycle other than a "new motor vehicle," a "nonconventional type motor vehicle" or a manufactured home subject to real property taxation.
b. Prior to selling a used motor vehicle in this State a seller shall require that a buyer submit satisfactory proof of identity and age, and as a condition for purchasing the used motor vehicle, satisfactory proof that the buyer's presence in the United States is authorized under federal law.
If the seller has reasonable cause to suspect that any document presented by a buyer as proof of identity, age or legal residency is altered, false or otherwise invalid, the seller shall refuse to sell the used motor vehicle.
c. A seller who violates this section shall be subject to a fine not exceeding $500 or imprisonment in the county jail for not more than 60 days.
2. This act shall take effect immediately.
STATEMENT
This bill requires a person, who sells a used motor vehicle, to request that a purchaser submit certain identification as a condition of purchasing the motor vehicle. Under the provisions of the bill, if the seller has reasonable cause to suspect that any document presented by an applicant as proof of identity, age or legal residency is altered, false or otherwise invalid, the seller shall refuse to sell the used motor vehicle.
A seller who commits a violation under this bill is to be subject to a fine not exceeding $500 or imprisonment in the county jail for not more than 60 days.
