     Increases penalty for transfer of identification to enable purchase of alcohol by underage persons.

An Act increasing penalties for transfers of identification to enable purchase of alcohol and amending P.L.1968 c. 313.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 6 of P.L.1968 c.313 (C.33:1-81.7) is amended to read as follows:

     6.    It shall be unlawful for the owner of an identification card, as defined by this act, to transfer said card to any other person for the purpose of aiding such person to secure alcoholic beverages.  Any person who shall transfer such identification card for the purpose of aiding such transferee to obtain  alcoholic beverages shall be guilty of a misdemeanor and, upon conviction  thereof, shall be sentenced to pay a fine of not more than [$300.00] $500, or undergo  imprisonment for not more than 60 days.  Any person not entitled thereto who shall have unlawfully procured or have issued or transferred to him, as aforesaid, identification card or any person who shall make any false statement on any card required by subsection (c) hereof to be signed by him shall be guilty of a misdemeanor and, upon conviction thereof, shall be sentenced to pay a fine of not more than [$300.00] $500, or undergo imprisonment for not more than 60 days.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would increase the fine for transfer of an identity card to enable a person purchase alcohol.  Under current law, the fine for transferring or receiving an identity card in order to obtain alcoholic beverages is punishable by a fine of not more than $300 and imprisonment for not more than 60 days.  This bill would increase the fine from $300 to $500 for such transfers of identification cards.
