          tee on Education

        AN ACT to amend the education law, in relation to  prohibiting  co-loca-
          tion  of a charter school in a public school building in a city school
          district in a city having a population of one million or more inhabit-
          ants; and to repeal certain provisions of the  education  law  related
          thereto

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraphs (a-3), (a-4), (a-5), (d) and (e) of  subdivision
     2  3  of section 2853 of the education law are REPEALED and a new paragraph
     3  (d) is added to read as follows:
     4    (d) Notwithstanding any other provision of law  to  the  contrary,  no
     5  charter school shall be co-located in a public school building in a city
     6  school  district  in  a  city having a population of one million or more
     7  inhabitants.
     8    § 2. This act shall take effect on the first of July  next  succeeding
     9  the date on which it shall have become a law.
