       AN ACT to amend the education law, in relation to limitation on expendi-
         tures and authorizing expenditures under a contingency budget
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Section 1718 of the education law is amended by adding two
    2  new subdivisions 3 and 4 to read as follows:
    3    3. NOTWITHSTANDING ANY PROVISIONS OF THE LAW TO THE CONTRARY, WHENEVER
    4  THE LEGISLATURE DOES NOT PASS A BUDGET BY THE THIRD TUESDAY IN MAY,  ANY
    5  FUNDS THAT A DISTRICT RECEIVES IN EXCESS OF FUNDS APPROVED BY THE VOTERS
    6  AS  A RESULT OF THE LEGISLATURE'S SUBSEQUENT PASSAGE OF A BUDGET, MAY BE
    7  SPENT ON ANY ORDINARY CONTINGENT EXPENSES. SUCH EXPENDITURES  SHALL  NOT
    8  BE INCLUDED FOR PURPOSES OF CALCULATING A DISTRICT'S AUTHORIZED EXPENSES
    9  UNDER A CONTINGENCY BUDGET.
   10    4. NOTWITHSTANDING ANY PROVISIONS OF THE LAW TO THE CONTRARY, WHENEVER
   11  THE LEGISLATURE APPROVES A BUDGET SUBSEQUENT TO THE DATE OF SUBMITTAL TO
   12  THE DEPARTMENT FOR SCHOOL REPORT CARDS, DISTRICTS MAY AMEND THEIR BUDGET
   13  PROPOSALS  TO  REFLECT ANY INCREASED FUNDING AS A RESULT OF THE LEGISLA-
   14  TURE'S SUBSEQUENT PASSAGE OF A BUDGET.
   15    S 2. This act shall take effect immediately.
