ENGLEBRIGHT -- read once and referred to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- again reported from said committee with amendments, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to requiring health- care workers practicing in close proximity to children less than twelve months of age to be vaccinated against pertussis The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2166 of the public health law, as added by chapter 2 573 of the laws of 1999, is amended to read as follows: 3 § 2166. Immunization; regulations. 1. The commissioner may promulgate 4 regulations with respect to immunization conducted by a home care 5 services agency licensed pursuant to section thirty-six hundred five of 6 this chapter or certified pursuant to section thirty-six hundred eight 7 of this chapter, facilities or institutions established under article 8 twenty-eight of this chapter, and other health care providers and prac- 9 titioners, including, but not limited to, standards for the quality of 10 care and services provided, consistent with the education law. 11 2. Personnel working in health care settings who are reasonably 12 expected to come into contact with children twelve months old or younger 13 in the health care setting shall be vaccinated against pertussis, as 14 provided in regulations of the commissioner. 15 3. Regulations promulgated under this section shall be consistent with 16 the standards approved by the United States public health service. 17 § 2. This act shall take effect on the first of January next succeed- 18 ing the date upon which it shall have become a law. Effective immediate- 19 ly the addition, amendment and/or repeal of any rule or regulation 20 necessary for the implementation of this act on its effective date are 21 authorized to be made and completed on or before such date.
