        AN ACT to amend the education law, in relation to  providing  a  program
          fee option for graduate students

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph h of subdivision 2 of section 355 of  the  educa-
     2  tion law is amended by adding a new subparagraph 11 to read as follows:
     3    (11) The trustees shall also establish an access fee option that would
     4  allow a student who is a candidate for a graduate or professional degree
     5  and  has  completed  at least thirty credits, and is on leave from full-
     6  time study, to maintain access to certain facilities  within  the  state
     7  university  such as libraries, computers and/or student centers in order
     8  to continue a research project or to pursue other academic  requirements
     9  established  by  the state university, without being enrolled in regular
    10  credit courses. Such fee shall not exceed the cost of one credit of  the
    11  student's program of graduate or doctorate course work as established by
    12  the  trustees of the state university.  All current and future mandatory
    13  university fees, with the exclusion of the graduate student  association
    14  student activity fee, shall not be charged to a graduate student serving
    15  a  full-time  or half-time appointment as a graduate teaching assistant,
    16  graduate assistant, graduate research assistant, graduate research asso-
    17  ciate, or graduate teaching associate.
    18    § 2. This act shall take effect immediately.
