The section heading of section 89 of the retirement and 2 social security law, as amended by section 139 of subpart B of part C of 3 chapter 62 of the laws of 2011, is amended to read as follows: 4 Retirement of members in the uniformed personnel in institutions under 5 the jurisdiction of the department of corrections and community super- 6 vision or who are security hospital treatment assistants, OR WHO ARE 7 WARRANT AND TRANSFER OFFICERS OR SENIOR WARRANT AND TRANSFER OFFICERS; 8 new plan. 9 S 2. Subdivision a of section 89 of the retirement and social security 10 law, as amended by section 139 of subpart B of part C of chapter 62 of 11 the laws of 2011, is amended to read as follows: 12 a. Any member in the uniformed personnel in institutions under the 13 jurisdiction of the department of corrections and community supervision, 14 as hereinafter defined, who enters or re-enters service on or after the 15 effective date of this section, or who is a security hospital treatment 16 assistant who enters or [reenters] RE-ENTERS service on or after the 17 effective date of the amendment permitting security hospital treatment 18 assistants to be covered by this section, OR WHO IS A WARRANT AND TRANS- 19 FER OFFICER OR A SENIOR WARRANT AND TRANSFER OFFICER WHO ENTERS OR 20 RE-ENTERS SERVICE ON OR AFTER THE EFFECTIVE DATE OF THE AMENDMENT 21 PERMITTING WARRANT AND TRANSFER OFFICERS AND SENIOR WARRANT AND TRANSFER EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11108-02-4 A. 7573--A 2 1 OFFICERS TO BE COVERED BY THIS SECTION, shall contribute on the basis 2 provided for by this section. 3 S 3. Paragraph 2 of subdivision e of section 89 of the retirement and 4 social security law, as amended by section 139 of subpart B of part C of 5 chapter 62 of the laws of 2011, is amended to read as follows: 6 2. A pension which, together with such annuity and a pension which is 7 the actuarial equivalent of the reserves for-increased-take-home pay to 8 which he or she may then be entitled, if any, shall equal one-fiftieth 9 of his or her final average salary for each year of creditable service 10 in the uniformed personnel in institutions under the jurisdiction of the 11 department of corrections and community supervision or for each year of 12 creditable service as a security hospital treatment assistant under the 13 jurisdiction of the office of mental health, OR FOR EACH YEAR OF CREDIT- 14 ABLE SERVICE AS A WARRANT AND TRANSFER OFFICER OR SENIOR WARRANT AND 15 TRANSFER OFFICER UNDER THE JURISDICTION OF THE DEPARTMENT OF CORRECTIONS 16 AND COMMUNITY SUPERVISION, as hereinafter defined. This pension shall 17 not exceed the amount needed to make the total amount of the benefits 18 provided under paragraphs one and two of this subdivision e equal to 19 one-half of his or her final average salary. 20 S 4. The opening paragraph of paragraph 3 of subdivision e of section 21 89 of the retirement and social security law, as amended by section 139 22 of subpart B of part C of chapter 62 of the laws of 2011, is amended to 23 read as follows: 24 An additional pension equal to the pension for any creditable service 25 rendered while not in the uniformed personnel in institutions under the 26 jurisdiction of the department of corrections and community supervision 27 and rendered while not serving as a security hospital treatment assist- 28 ant under the jurisdiction of the office of mental health, AND RENDERED 29 WHILE NOT SERVING AS A WARRANT AND TRANSFER OFFICER OR SENIOR WARRANT 30 AND TRANSFER OFFICER UNDER THE JURISDICTION OF THE DEPARTMENT OF 31 CORRECTIONS AND COMMUNITY SUPERVISION, as hereinafter defined, as 32 provided under paragraphs two and three of subdivision a of section 33 seventy-five of this article. This pension shall: 34 S 5. Subdivision f of section 89 of the retirement and social security 35 law, as amended by section 139 of subpart B of part C of chapter 62 of 36 the laws of 2011, is amended to read as follows: 37 f. The increased pensions to members of the uniformed personnel in 38 institutions under the jurisdiction of the department of corrections and 39 community supervision or to members who are security hospital treatment 40 assistants under the jurisdiction of the office of mental health, OR TO 41 MEMBERS WHO ARE WARRANT AND TRANSFER OFFICERS OR SENIOR WARRANT AND 42 TRANSFER OFFICERS UNDER THE JURISDICTION OF THE DEPARTMENT OF 43 CORRECTIONS AND COMMUNITY SUPERVISION, as provided by this section, 44 shall be paid from additional contributions made by the state on account 45 of such member. The actuary of the retirement system shall compute the 46 additional contribution of each member who elects to receive the special 47 benefits provided under this section. Such additional contributions 48 shall be computed on the basis of contributions during the prospective 49 service of such member which will cover the liability of the retirement 50 system for such extra pensions. 51 S 6. Subdivision g of section 89 of the retirement and social security 52 law, as amended by section 139 of subpart B of part C of chapter 62 of 53 the laws of 2011, is amended to read as follows: 54 g. In computing the twenty-five years of completed service of a member 55 in the uniformed personnel in institutions under the jurisdiction of the 56 department of corrections and community supervision or of a member who A. 7573--A 3 1 is a security hospital treatment assistant under the jurisdiction of the 2 office of mental health, OR OF A MEMBER WHO IS A WARRANT AND TRANSFER 3 OFFICER OR SENIOR WARRANT AND TRANSFER OFFICER UNDER THE JURISDICTION OF 4 THE DEPARTMENT OF CORRECTIONS AND COMMUNITY SUPERVISION, as hereinafter 5 defined, full credit shall be given and full allowance shall be made for 6 service of such member in war after world war 1 as defined in section 7 two of this chapter, provided such member at the time of his or her 8 entrance into the armed forces was in state service. 9 S 7. Subdivision i of section 89 of the retirement and social security 10 law, as amended by section 139 of subpart B of part C of chapter 62 of 11 the laws of 2011, is amended to read as follows: 12 i. As used in this section, "uniformed persons" or "uniformed person- 13 nel" in institutions under the jurisdiction of the department of 14 corrections and community supervision or "security hospital treatment 15 assistants" under the jurisdiction of the office of mental health OR 16 "WARRANT AND TRANSFER OFFICERS OR SENIOR WARRANT AND TRANSFER OFFICERS" 17 UNDER THE JURISDICTION OF THE DEPARTMENT OF CORRECTIONS AND COMMUNITY 18 SUPERVISION mean officers or employees holding the titles hereinafter 19 set forth in institutions under the jurisdiction of the department of 20 corrections and community supervision or under the jurisdiction of the 21 office of mental health, namely: correction officers, prison guards, 22 correction sergeants, correction lieutenants, correction captains, depu- 23 ty assistant superintendent or warden, deputy warden or deputy super- 24 intendent, superintendents and wardens, assistant director and director 25 of correction reception center, director of correctional program, 26 assistant director of correctional program, director of community 27 correctional center, community correctional center assistant, correction 28 hospital officers, male or female, correction hospital senior officers, 29 correction hospital charge officer, correction hospital supervising 30 officer, correction hospital security supervisor, correction hospital 31 chief officer, correction youth camp officer, correction youth camp 32 supervisor, assistant supervisor, correctional camp superintendent, 33 assistant correctional camp superintendent, director of crisis inter- 34 vention unit, assistant director of crisis intervention unit, security 35 hospital treatment assistants, security hospital treatment assistants 36 (Spanish speaking), security hospital senior treatment assistants, secu- 37 rity hospital supervising treatment assistants [and], security hospital 38 treatment chiefs, AND WARRANT AND TRANSFER OFFICERS AND SENIOR WARRANT 39 AND TRANSFER OFFICERS. Previous service rendered under the titles by 40 which such positions were formerly designated and previous service 41 rendered as a narcotic addiction control commission officer shall 42 constitute creditable service. PREVIOUS SERVICE RENDERED UNDER THE 43 TITLES WARRANT AND TRANSFER OFFICER AND SENIOR WARRANT AND TRANSFER 44 OFFICER UNDER THE JURISDICTION OF THE FORMER DIVISION OF PAROLE SHALL 45 CONSTITUTE CREDITABLE SERVICE. Notwithstanding any provision of law to 46 the contrary, any employee of the department of corrections and communi- 47 ty supervision who became enrolled under this section by reason of 48 employment as a uniformed person in an institution under the jurisdic- 49 tion of the department of corrections and community supervision shall be 50 entitled to full retirement credit for, and full allowance shall be made 51 under this section for the service of such employee, not to exceed 52 twelve years, while assigned to the training academy or central office, 53 in the following titles, namely: correction officer, correction 54 sergeant, correction lieutenant, correction captain, correctional 55 services investigator, senior correctional services employee investi- 56 gator, correctional services fire and safety coordinator, director of A. 7573--A 4 1 special housing and inmate disciplinary program, assistant director of 2 special housing and inmate disciplinary program, assistant chief of 3 investigations, director of CERT operations, correctional facility oper- 4 ations specialist, director of security staffing project, correctional 5 security technical services specialist, assistant commissioner and depu- 6 ty commissioner. 7 S 8. Section 89 of the retirement and social security law is amended 8 by adding a new subdivision l to read as follows: 9 L. ANY MEMBER WHO, ON OR BEFORE THE EFFECTIVE DATE OF THIS SUBDIVI- 10 SION, IS A WARRANT AND TRANSFER OFFICER OR SENIOR WARRANT AND TRANSFER 11 OFFICER UNDER THE JURISDICTION OF THE DEPARTMENT OF CORRECTIONS AND 12 COMMUNITY SUPERVISION MAY, BY FILING AN ELECTION WITHIN ONE YEAR AFTER 13 THE EFFECTIVE DATE OF THIS SUBDIVISION, ELECT TO BE SUBJECT TO THE 14 PROVISIONS OF THIS SECTION. SUCH ELECTION SHALL BE IN WRITING, SHALL BE 15 DULY EXECUTED AND FILED WITH THE COMPTROLLER AND SHALL BE IRREVOCABLE. 16 S 9. All past service costs shall be borne by the state of New York as 17 a one-time payment. 18 S 10. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, Section 50: This bill would allow warrant and transfer officers under the juris- diction of the department of corrections to be covered by the provisions of section 89 of the Retirement and Social Security Law, a twenty-five (25) year half pay retirement plan. In addition this will allow all service as a warrant and transfer officer to be creditable towards retirement for all officers subject to the provisions of such plan. If this bill is enacted, we anticipate that there will be an increase of approximately $119,000 in the annual contributions of the State of New York for the fiscal year ending March 31, 2015. In addition to the annual contributions discussed above, there will be an immediate past service cost of approximately $463,000 which would be borne by the State of New York as a one-time payment, assuming a payment date of March 1, 2015. These estimated costs are based on 24 known affected officers having a total estimated annual salary for the fiscal year ending March 31, 2014 approximately $2.3 million. Summary of relevant resources: The membership data used in measuring the impact of the proposed change was the same as that used in the March 31, 2013 actuarial valu- ation. Distributions and other statistics can be found in the 2013 Report of the Actuary and the 2013 Comprehensive Annual Financial Report. The actuarial assumptions and methods used are described in the 2010, 2011, 2012 and 2013 Annual Report to the Comptroller on Actuarial Assumptions, and the Codes Rules and Regulations of the State of New York: Audit and Control. The Market Assets and GASB Disclosures are found in the March 31, 2013 New York State and Local Retirement System Financial Statements and Supplementary Information.
