STATE OF NEW YORK ________________________________________________________________________ 7596 2021-2022 Regular Sessions IN ASSEMBLY May 18, 2021 ___________ Introduced by M. of A. BICHOTTE HERMELYN -- read once and referred to the Committee on Governmental Operations AN ACT to amend the state finance law, in relation to increasing the state discretionary buying threshold without a formal competitive process for certain commodities from certain businesses The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 163 of the state finance law, as 2 amended by chapter 96 of the laws of 2019, is amended to read as 3 follows: 4 6. Discretionary buying thresholds. Pursuant to guidelines established 5 by the state procurement council: the commissioner may purchase services 6 and commodities in an amount not exceeding eighty-five thousand dollars 7 without a formal competitive process; state agencies may purchase 8 services and commodities in an amount not exceeding fifty thousand 9 dollars without a formal competitive process; and state agencies may 10 purchase commodities or services from small business concerns or those 11 certified pursuant to articles fifteen-A and seventeen-B of the execu- 12 tive law, or commodities or technology that are recycled or remanufac- 13 tured in an amount not exceeding [five hundred thousand] one million 14 dollars without a formal competitive process and for commodities that 15 are food, including milk and milk products, grown, produced or harvested 16 in New York state in an amount not to exceed two hundred thousand 17 dollars, without a formal competitive process. 18 § 2. This act shall take effect on the sixtieth day after it shall 19 have become a law; provided, however, that the amendments to section 163 20 of the state finance law, made by section one of this act, shall not 21 affect the repeal of such section and be deemed repealed therewith. 22 Effective immediately the addition, amendment and/or repeal of any rule 23 or regulation necessary for the implementation of this act on its effec- 24 tive date are authorized to be made and completed on or before such 25 date.
