CROUCH -- read once and referred to the Committee on Local Governments -- recommitted to the Committee on Local Govern- ments in accordance with Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to legalize, validate, ratify and confirm the abolition of the offices of fire commissioners by the town of Deposit, in the county of Delaware; and providing for the repeal of such provisions upon expira- tion thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any provision of the town law or insurance 2 law, all proceedings and actions taken by the town of Deposit in the 3 county of Delaware, in relation to the abolition of the offices of fire 4 commissioners and transfer of their functions to the town board and town 5 supervisor, including executing contracts for fire protection, redis- 6 tributing foreign fire insurance premium tax funds and the establishment 7 of any account of funds from real property taxes of the fire district, 8 are hereby legalized, validated, ratified and confirmed. 9 S 2. Notwithstanding the defects described in section one of this act, 10 the town board of the town of Deposit is hereby authorized to initiate 11 proceedings pursuant to article 17-A of the general municipal law to 12 dissolve the offices of fire commissioners as if the town board were the 13 governing body of the offices of fire commissioners. 14 S 3. This act shall take effect immediately and shall expire and be 15 deemed repealed on July 1, 2013.
