STATE OF NEW YORK ________________________________________________________________________ 8911 IN ASSEMBLY January 19, 2022 ___________ Introduced by M. of A. O'DONNELL -- read once and referred to the Committee on Cities AN ACT to amend the administrative code of the city of New York, in relation to requiring containerized waste systems for certain residen- tial buildings with more than one hundred fifty units The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The administrative code of the city of New York is amended 2 by adding a new section 27-2021.1 to read as follows: 3 § 27-2021.1 Containerized waste systems. a. Notwithstanding any 4 provision of law, rule or regulation to the contrary, any newly 5 constructed residential building or development containing more than one 6 hundred fifty units or any residential building or development renovated 7 after the effective date of this section containing more than one 8 hundred fifty units, shall include a containerized waste system. 9 b. For the purposes of this section, a "containerized waste system" 10 shall mean a waste management system that utilizes sealed containers 11 with dimensions of up to eight feet in width, five feet in height and 12 twenty feet in length. 13 c. Each containerized waste system required under this section shall, 14 at a minimum, be rat-proof, fireproof and constructed to prevent leak- 15 age. Each container shall be properly maintained and shall remain in 16 its designated place of storage. Yard sweepings, hedge cuttings, grass, 17 leaves, earth, stone or bricks shall not be placed in such containerized 18 waste systems. 19 d. Any additional rules or regulations necessary to implement the 20 provisions of this section shall be promulgated by the commissioner of 21 buildings in consultation with the commissioner of sanitation and the 22 commissioner of health and mental hygiene. 23 § 2. This act shall take effect on the one hundred eightieth day after 24 it shall have become a law. Effective immediately, the addition, amend- 25 ment and/or repeal of any rule or regulation necessary for the implemen- 26 tation of this act on its effective date are authorized to be made on or 27 before such date.
