        AN ACT authorizing the alienation of certain parklands in  the  town  of
          Islip, county of Suffolk
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subject to the provisions of this act, the town  of  Islip,
     2  acting by and through its town board, is hereby authorized to discontin-
     3  ue  as  parklands  and alienate the lands more particularly described in
     4  section three of this act, and to sell and convey  such  parklands  upon
     5  such terms and conditions as determined by the town board of Islip.
     6    § 2. The authorization contained in section one of this act shall only
     7  be  effective on the condition that the town of Islip shall dedicate the
     8  lands described in section four of this act as  additional  parkland  of
     9  the town.
    10    §  3.  The  land  to  be  discontinued  as  parkland and alienated and
    11  conveyed is bounded and described as follows:
    12    BEGINNING AT A POINT, said point being 125 ft. east  from  the  inter-
    13  section  formed from the easterly side of Lowell Ave. and the north side
    14  of Cypress Ave.
    15    RUNNING THENCE in a northerly direction N7°40'00"W 233.00  feet  to  a
    16  point;
    17    RUNNING  THENCE  in  an easterly directly N82°20"00"E 125.00 feet to a
    18  point;
    19    RUNNING THENCE in a northerly direction N7°40"00"W  33.00  feet  to  a
    20  point;
    21    RUNNING  THENCE  in an easterly direction N82°20'00"E 100.00 feet to a
    22  point;
    23    RUNNING THENCE in a southerly direction S7°40'00"E 266.00  feet  to  a
    24  point;
    25    RUNNING  THENCE  in  a  westerly  direction S82°20'00"W 225.00 feet to
    26  point or place of beginning. The said parcel containing 1.2 acres ±.

     1    § 4. The town of Islip, acting by  and  through  its  governing  body,
     2  shall  dedicate  the  replacement  lands, for use as parkland for public
     3  park purposes consisting of 1.28 acres described as follows:
     4    BEGINNING  AT A POINT, said point being 1585.27 feet south from inter-
     5  section formed by the west side of Lowell Avenue and the south  side  of
     6  Clayton Avenue:
     7    RUNNING  THENCE  in  a westerly direction S82°20'22"W 500.71 feet to a
     8  point;
     9    RUNNING THENCE in a northerly direction  N9°01'29"W 101.18 feet  to  a
    10  point;
    11    RUNNING  THENCE  in  a easterly direction N82°20'22"W 533.12 feet to a
    12  point;
    13    RUNNING THENCE in a southerly direction S07°39'38"E 101.18 feet to the
    14  point or place of beginning.
    15    § 5. In the event that the parklands to be acquired and  dedicated  by
    16  the  town of Islip pursuant to this act are not of equal or greater fair
    17  market value to the parklands to be discontinued and conveyed, the  town
    18  of  Islip  shall dedicate the difference of the fair market value of the
    19  lands to be alienated and the lands to be dedicated for the  acquisition
    20  of additional parklands and/or for capital improvements to existing park
    21  and recreational facilities.
    22    §  6. If the land that is the subject of this act has received funding
    23  pursuant to the federal land and water conservation fund, the discontin-
    24  uance of parklands authorized by the provisions of this  act  shall  not
    25  occur  until the municipality has complied with the federal requirements
    26  pertaining to the conversion  of  parklands,  including  satisfying  the
    27  secretary  of  the  interior  that  the  discontinuance will include all
    28  conditions which the secretary of the interior deems necessary to assure
    29  the substitution of other lands shall be equivalent in fair market value
    30  and recreational usefulness to the lands being discontinued.
    31    § 7. This act shall take effect immediately.
