        Introduced  by  Sen.  COONEY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Codes

        AN ACT to amend the penal  law,  in  relation  to  personal  cultivation
          facilities

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 3 of section 222.15 of the penal law, as  added
     2  by chapter 92 of the laws of 2021, is amended to read as follows:
     3    3.  The personal cultivation of cannabis shall only be permitted with-
     4  in, or on the grounds of, a person's private  residence  or  a  licensed
     5  personal  cultivation  facility, pursuant to any regulations promulgated
     6  by the cannabis control board in accordance with section thirteen of the
     7  cannabis law.
     8    § 2. This act shall take effect immediately.
