RITCHIE -- (at request of the Department of Agricul- ture and Markets) -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to nursery growers and dealers registration THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 163-a of the agriculture and markets law, as 2 amended by section 5 of part I1 of chapter 62 of the laws of 2003, is 3 amended to read as follows: 4 S 163-a. Application. Any nursery grower or nursery dealer, except 5 those nursery dealers selling, transporting, or handling for sale or 6 otherwise disposing of nursery stock, exclusively consisting of indoor 7 plants, at a retail level, desiring to sell, or selling, or handling for 8 sale, or otherwise disposing of nursery stock in this state shall make 9 application in writing to the commissioner upon a form prescribed by the 10 commissioner. The application shall be [made on or before the first day 11 of November and every other year thereafter for the registration period 12 beginning in December and shall be] accompanied by a fee of one hundred 13 dollars FOR A REGISTRATION EFFECTIVE FOR TWO YEARS FROM THE DATE OF 14 ISSUANCE. The commissioner may exempt from the payment of such fees 15 agencies or authorities of the state; county, city, town, or village 16 governments; or other entities providing benefit to the general public, 17 including but not limited to, botanical gardens. 18 S 2.
