S T A T E O F N E W Y O R K ________________________________________________________________________ 4741 2015-2016 Regular Sessions I N S E N A T E April 15, 2015 ___________ Introduced by Sen. GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to private school agent's certificates THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph a of subdivision 1 of section 5004 of the educa- 2 tion law, as added by chapter 887 of the laws of 1990, is amended to 3 read as follows: 4 a. No party may, for a consideration or remuneration procure, solicit 5 or enroll any student for instruction in or given by any school within 6 or without the state of New York, unless (i) the party is a salaried 7 employee of the school [and], (ii) the party shall have secured a 8 private school agent's certificate from the department pursuant to regu- 9 lations of the commissioner, AND (III) THE PARTY SERVES AS AN ONLINE 10 EDUCATION MARKETPLACE FACILITATING INFORMATION BETWEEN STUDENTS AND 11 SCHOOLS. UNDER THIS SECTION "ONLINE EDUCATION MARKETPLACE" MEANS A 12 NEUTRAL FORUM IN WHICH, OR BY MEANS OF WHICH, A STUDENT MAY ENROLL IN 13 CLASSES FROM A SCHOOL, OR ARRANGES FOR THE EXCHANGE OF INFORMATION OR 14 MESSAGES BETWEEN THE STUDENT AND SCHOOL AND THE ONLINE EDUCATION MARKET- 15 PLACE. 16 S 2.
