Bill Title: Provides that no antidepressant or anti-anxiety medication which has an increased risk of suicidal behavior in individuals shall be dispensed without consultation and other information to certain persons receiving outpatient services.

       Introduced  by Sen. HAMILTON -- read twice and ordered printed, and when
         printed to be committed to the Committee on Mental Health and Develop-
         mental Disabilities
       AN ACT to amend the mental hygiene law, in relation to the  prescription
         of  antidepressant and antianxiety medications which have an increased
         risk of suicidal behavior
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The mental hygiene law is amended by adding a new section
    2  7.47 to read as follows:
    3  S 7.47 ANTIDEPRESSANT AND ANTIANXIETY MEDICATIONS; SUICIDE RISK.
    4    (A) WHEN A PATIENT RECEIVES A PRESCRIPTION FOR  AN  ANTIDEPRESSANT  OR
    5  ANTIANXIETY  MEDICATION IN AN OUTPATIENT SETTING, AND THE MEDICATION HAS
    6  AN INCREASED RISK OF SUICIDALITY, THE OFFICE SHALL IDENTIFY SUCH MEDICA-
    7  TIONS AND SHALL REQUIRE PHARMACISTS IN THE COURSE OF CONSULTATION,  UPON
    8  THE  FIRST  TIME DISPENSING OF THE MEDICATION TO THE PATIENT, TO PROVIDE
    9  THE FOLLOWING:
   10    (1) THE TOLL-FREE SUICIDE PREVENTION LIFELINE TELEPHONE NUMBER  ESTAB-
   11  LISHED BY THE OFFICE;
   12    (2)  THE  SUICIDE  PREVENTION LIFELINE WEBSITE INTERNET ADDRESS ESTAB-
   13  LISHED BY THE OFFICE; AND
   14    (3) A PAMPHLET PUBLISHED BY THE  OFFICE  SETTING  FORTH  ALL  RELEVANT
   15  INFORMATION  REGARDING  THE  INCREASED RISK OF SUICIDE AND SUICIDAL SIDE
   16  EFFECTS ASSOCIATED WITH THE MEDICATION, INCLUDING, BUT NOT  LIMITED  TO,
   17  INFORMATION  SETTING  FORTH  THE  WARNING  SIGNS  ASSOCIATED  WITH  SUCH
   18  SUICIDAL BEHAVIOR AND ANY OTHER INFORMATION THE OFFICE DEEMS RELEVANT.
   19    (B) ANY CONSULTATION REQUIRED BY SUBDIVISION (A) OF THIS SECTION  WITH
   20  A  PERSON  UNDER  SEVENTEEN  YEARS OF AGE SHALL REQUIRE THAT A PARENT OR
   21  LEGAL GUARDIAN OF SUCH PERSON BE IN ATTENDANCE DURING SUCH CONSULTATION.
   22    (C) NO MEDICATION DESCRIBED IN SUBDIVISION (A) OF THIS  SECTION  SHALL
   23  BE  DISPENSED,  DISPERSED OR OTHERWISE GIVEN TO A PERSON UNDER SEVENTEEN
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  YEARS OF AGE UNLESS A PARENT OR LEGAL GUARDIAN  OF  SUCH  PERSON  IS  IN
    2  ATTENDANCE.
    3    (D)  THE OFFICE IS AUTHORIZED AND DIRECTED TO PROMULGATE ANY RULES AND
    4  REGULATIONS AND PREPARE PAMPHLETS NECESSARY TO IMPLEMENT THE  PROVISIONS
    5  OF THIS SECTION.
    6    S  2.  This  act shall take effect on the ninetieth day after it shall
    7  have become a law; provided, however, that  effective  immediately,  the
    8  addition,  amendment  and/or  repeal of any rule or regulation necessary
    9  for the implementation of this act on its effective date  is  authorized
   10  to be made and completed on or before such date.
