STATE OF NEW YORK ________________________________________________________________________ 6446 2021-2022 Regular Sessions IN SENATE April 29, 2021 ___________ Introduced by Sen. REICHLIN-MELNICK -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to establishing the eating disorders in children task force The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 2500-m to read as follows: 3 § 2500-m. Eating disorders in children task force. 1. The commissioner 4 shall convene an eating disorders in children task force to study and 5 create a standardized approach to, and develop best practices and guide- 6 lines for screening eating disorders in children. 7 2. The task force shall be chaired by the commissioner or by such 8 officer or employee of the department as shall be designated by the 9 commissioner. The membership of the task force may include represen- 10 tation from appropriate state agencies and members that represent commu- 11 nity agencies, hospitals, or other entities dedicated to researching or 12 providing services to children with eating disorders. The task force 13 shall include the following members, to be appointed by the commission- 14 er: 15 (a) one representative from New York chapter one of the American Acad- 16 emy of Pediatrics; 17 (b) one representative from New York chapter two of the American Acad- 18 emy of Pediatrics; and 19 (c) one representative from New York chapter three of the American 20 Academy of Pediatrics. 21 3. Such task force shall establish recommendations, for use by pedia- 22 tric primary care providers, for best practice protocols and guidelines 23 for early screening of children for eating disorders, as defined by 24 subdivision (a) of section 30.02 of the mental hygiene law. Such recom- 25 mendations shall incorporate the standards and guidelines established by EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD08313-02-1S. 6446 2 1 the American Academy of Pediatrics, but shall not be limited to such 2 standards and guidelines. 3 4. The commissioner shall promulgate any rules and regulations neces- 4 sary to implement the provisions of this section. 5 5. The task force shall provide an initial report to the governor and 6 the legislature of its findings, conclusions, recommendations and activ- 7 ities already undertaken by the task force, not later than one year 8 after the effective date of this section, and shall provide a report 9 every two years thereafter with updated findings, conclusions and recom- 10 mendations and shall submit with such biennial report legislative 11 proposals as it deems necessary to implement its recommendations. 12 § 2. This act shall take effect immediately.
