        Introduced  by  Sen. KENNEDY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation

        AN ACT to amend the vehicle and traffic law and  the  parks,  recreation
          and  historic  preservation  law,  in  relation to fees for snowmobile
          trail development and maintenance

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Subdivision 4-a of section 2222 of the vehicle and traffic
     2  law, as amended by chapter 609 of the laws of 2005, is amended  to  read
     3  as follows:
     4    4-a.  Additional  fee.  In  addition to the other fees provided for in
     5  paragraphs (a), (b) and (c) of subdivision  four  of  this  section  the
     6  commissioner  shall, upon application in such cases for the registration
     7  of a snowmobile or the renewal thereof, collect the annual [ninety]  one
     8  hundred  fifteen dollar fee for residents and [ninety] one hundred forty
     9  dollar fee for nonresidents and a thirty-five dollar fee  for  residents
    10  and  thirty-five  dollar  fee for nonresidents who provide proof, at the
    11  time of registration, that such individual is a member of  an  organized
    12  New  York  state  snowmobile club that is a member of the New York state
    13  snowmobile association or is a member of an  organized  New  York  state
    14  snowmobile  club  that is a trail maintenance entity and a member of the
    15  New York state snowmobile association which are imposed by section 21.07
    16  of the parks, recreation and historic preservation  law.  In  the  event
    17  that an individual seeking snowmobile club membership is unable, for any
    18  reason,  to  secure  such club membership, he or she may contact the New
    19  York state snowmobile association, who shall secure such membership  for
    20  such  person.  This fee shall also be collected from dealers at the time
    21  of original registration and at the time of each  renewal.  The  commis-
    22  sioner  shall effectuate regulations regarding what is required as proof
    23  of membership in an organized New York state snowmobile club that  is  a

     1  trail  maintenance  entity and a member of the New York state snowmobile
     2  association for the purposes of this subdivision.
     3    §  2.  Subdivision  1  of  section  21.07 of the parks, recreation and
     4  historic preservation law, as amended by chapter  609  of  the  laws  of
     5  2005, is amended to read as follows:
     6    1.  A  fee  of  [ninety] one hundred fifteen dollars is hereby imposed
     7  upon the resident, and [ninety]  one  hundred  forty  dollars  upon  the
     8  nonresident,  owner of a snowmobile for the snowmobile trail development
     9  and maintenance fund to be paid to the commissioner  of  motor  vehicles
    10  upon  the  registration  thereof  in  addition  to  the registration fee
    11  required by the vehicle and traffic law, the payment of which fee hereby
    12  imposed shall be a condition  precedent  to  such  individual  resident,
    13  individual nonresident or dealer registration.
    14    § 3. This act shall take effect immediately.
