STATE OF NEW YORK ________________________________________________________________________ 7219 IN SENATE January 4, 2018 ___________ Introduced by Sen. YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the village law and the public officers law, in relation to residency requirements for the office of court clerk and deputy clerk/treasurer in the village of Mount Morris, in the county of Livingston The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3-300 of the village law is amended by adding a 2 new subdivision 28 to read as follows: 3 28. Notwithstanding any provisions of this chapter or any other gener- 4 al law, local law, ordinance or special act, the village board of trus- 5 tees of the incorporated village of Mount Morris, Livingston county, 6 may, by resolution, provide that the office of court clerk and deputy 7 clerk/treasurer of such village may be held by a person who is not a 8 resident of such village, provided that such person resides in the coun- 9 ty of Livingston or in an adjoining county within the state of New York. 10 § 2. Section 3 of the public officers law is amended by adding a new 11 subdivision 67 to read as follows: 12 67. In the village of Mount Morris, Livingston county, the provisions 13 of this section requiring a person to be a resident of the political 14 subdivision or municipal corporation of the state for which he or she 15 shall be chosen or within which his or her official functions are 16 required to be exercised, shall not prevent a person from holding the 17 office of village court clerk and deputy clerk/treasurer of the village 18 of Mount Morris, provided that such person resides in the county in 19 which such village is located or an adjoining county within the state of 20 New York. Provided, however, the person performing the functions of 21 village court clerk and deputy clerk/treasurer in any other village 22 shall be a resident of such village, unless otherwise provided by law. 23 § 3.
