        Introduced  by  Sen.  BROOKS -- read twice and ordered printed, and when
          printed to be committed to the Committee on Local Government

        AN ACT to amend the Nassau county civil divisions act,  in  relation  to
          the  Volunteer  and  Exempt Fireman's Benevolent Association of Nassau
          county

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Section 632.5 of the Nassau county civil divisions act, as
     2  added by chapter 237 of the laws of 1940, is amended to read as follows:
     3    § 632.5 Management and control. The control and disposal of the funds,
     4  property and estate of the corporation, the exercise of its powers,  and
     5  the  management  and  control  of  its  affairs,  except  as hereinafter
     6  provided, shall be vested in and exercised by a board of trustees  which
     7  shall  consist of [nine] eleven members of such corporation, to wit: the
     8  president, the vice-president, the secretary, the  financial  secretary,
     9  the  treasurer and [four] six other members having the title of trustee.
    10  The [four] six members having the title of trustee of  such  corporation
    11  shall  be  representative  respectively  of  each of the [four] six fire
    12  companies of the Massapequa Fire Department Inc. and each  trustee  must
    13  be  or  must  have  been  a  member of the fire company of which he is a
    14  representative. Such officers and trustees shall be elected at the annu-
    15  al meeting of such corporation in the manner prescribed by its by-laws.
    16    § 2. Section 632.6 of the Nassau county civil divisions act, as  added
    17  by chapter 237 of the laws of 1940, is amended to read as follows:
    18    §  632.6  Precept for payment of foreign fire insurance premium taxes.
    19  Such corporation shall collect and there shall be paid  to  it  all  tax
    20  imposed  by  section  [five  hundred  and fifty-three] nine thousand one
    21  hundred four of the insurance law, for fire department use  and  benefit
    22  upon  premiums  for  insurance  against  loss or damage by fire covering
    23  property situated within the Massapequa fire district  of  the  town  of
    24  Oyster  Bay,  Nassau  county,  New  York,  and within any duly organized
    25  territory in which the Massapequa Fire Department Inc. may be  obligated
    26  to render fire protection. The officer of said corporation designated by
    27  its by-laws to collect and receive the aforesaid tax shall have the same

     1  powers  as provided by law for the treasurer of the fire department with
     2  respect to such collection and receipt. Such corporation shall  also  be
     3  entitled  to receive a share of the tax imposed by section [five hundred
     4  and  fifty-four]  nine  thousand  one hundred five of the insurance law,
     5  based upon the business written in the territory with respect  to  which
     6  it  is  entitled  to  collect  and  receive  the tax under section [five
     7  hundred and fifty-three] nine thousand one hundred four of the insurance
     8  law. Such taxes shall only be used [for the care and relief of  disabled
     9  or  indigent  volunteer  and  exempt  firemen and their families] by the
    10  corporation in furtherance of its purposes as set forth in section 632.2
    11  of this act.
    12    § 3. This act shall take effect immediately.
