          printed to be committed to the Committee on Health

        AN ACT to amend the public health law, in relation to grants for  geria-
          tric  emergency departments; and in relation to grants from the health
          care facility transformation program

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  This  act  shall  be  known and may be cited as the "age-
     2  friendly health system enhancement act of 2024".
     3    § 2. Subdivision 8 of section 2825-g of  the  public  health  law,  as
     4  added  by  section  1  of  part  K of chapter 57 of the laws of 2022, is
     5  amended to read as follows:
     6    8. Selection of awards made by the department pursuant to subdivisions
     7  three, four, five, six and seven of this section shall be contingent  on
     8  an evaluation process acceptable to the commissioner and approved by the
     9  director  of  the  division of the budget. Disbursement of awards may be
    10  contingent on the health care provider as defined in subdivision two  of
    11  this section achieving certain process and performance metrics and mile-
    12  stones  that  are structured to ensure that the goals of the project are
    13  achieved. Such evaluation process shall include a preference  for  enti-
    14  ties that are designated  as "age-friendly" by the Institute for Health-
    15  care Improvement (IHI).
    16    §  3.  Subdivision  5  of  section 2825-h of the public health law, as
    17  added by section 1 of part P of chapter 57  of  the  laws  of  2023,  is
    18  amended to read as follows:
    19    5. Selection of awards made by the department pursuant to subdivisions
    20  three  and  four  of  this  section shall be contingent on an evaluation
    21  process acceptable to the commissioner and approved by the  director  of
    22  the  division of the budget. Disbursement of awards shall be conditioned
    23  on the awardee achieving certain process  and  performance  metrics  and
    24  milestones  as  determined  by  the commissioner. Such metrics and mile-
    25  stones shall be structured to ensure that the goals of the  project  are
    26  achieved,  and  such  metrics  and milestones shall be included in grant
    27  disbursement agreements or other contractual documents  as  required  by

     1  the commissioner. Such evaluation process shall include a preference for
     2  entities  that  are  designated   as "age-friendly" by the Institute for
     3  Healthcare Improvement (IHI).
     4    §  4. The public health law is amended by adding a new section 2831 to
     5  read as follows:
     6    § 2831. Geriatric emergency departments. Subject to  an  appropriation
     7  therefor,  the  commissioner  shall award accredited level two geriatric
     8  emergency departments in the state a  grant  of  five  hundred  thousand
     9  dollars per year for three years with the condition that each department
    10  grantee  shall  reach  level  one  status  within  twenty-four months of
    11  receiving the first grant award.
    12    § 5. Subdivision 1 of section 206 of the public health law is  amended
    13  by adding a new paragraph (w) to read as follows:
    14    (w)  establish, in conjunction with the office for the aging, a center
    15  for technical assistance in relation  to  age-friendly  health  systems.
    16  Such  center  shall be a public-private entity and shall utilize outside
    17  entities including but not  limited  to  the  Institute  for  Healthcare
    18  Improvement.
    19    §  6.  The section heading of section 2995-b of the public health law,
    20  as added by chapter 542 of the laws of 2000, is amended and a new subdi-
    21  vision 4 is added to read as follows:
    22    Hospital [report cards] performance data.
    23    4. Special designations.  Using criteria developed from data collected
    24  pursuant to this section and other criteria, the department shall desig-
    25  nate hospitals that are well equipped in terms of expertise and technol-
    26  ogy to provide certain types of care including  stroke  centers,  trauma
    27  centers, regional perinatal centers, burn centers, sexual assault foren-
    28  sic examiner (SAFE) programs and age-friendly designated hospitals.
    29    § 7. This act shall take effect immediately; provided,  however,  that
    30  the  implementation  of the provisions of section four of this act shall
    31  be subject to the appropriation of moneys specifically for the  purposes
    32  thereof.
