                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Permits person to register motorcycle originally manufactured
for off-road use if person submits certificate of approval issued
by licensed off-road motorcycle mechanic.

                        A BILL FOR AN ACT
Relating to off-road motorcycles.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Sections 2 and 3 of this 2013 Act are added to
and made a part of the  + }  { +  Oregon Vehicle Code. + }
  SECTION 2.  { + (1) As used in this section and section 3 of
this 2013 Act, 'off-road motorcycle' means a motorcycle that is
originally manufactured for use off the highway.
  (2) A person may register an off-road motorcycle for use on the
highways of this state only if:
  (a) The off-road motorcycle is modified to comply with the
equipment provisions of the vehicle code; and
  (b) The person has been issued a certificate of approval by an
off-road motorcycle mechanic licensed under section 3 of this
2013 Act.
  (3) The certificate of approval shall be in such form as may be
specified by the Department of Transportation.
  (4) The department shall adopt rules for the certification of
off-road motorcycles. The rules shall establish guidelines for
determining whether an off-road motorcycle has been modified in
such a way as to be properly equipped to operate on the highways
of this state in accordance with the Federal Motor Vehicle Safety
Standards and all other applicable safety standards established
by state and federal law. + }
  SECTION 3.  { + (1) The Department of Transportation may issue
an off-road motorcycle mechanic license to a person if the person
submits an application and pays a fee established by the
department by rule. The application shall be in such form as may
be specified by the department. The application must establish
that the person is qualified to inspect off-road motorcycles for
the purpose of ensuring that an off-road motorcycle meets the
requirements established under section 2 of this 2013 Act.
  (2) A person issued an off-road motorcycle mechanic license
under this section may inspect an off-road motorcycle for
compliance with the requirements described in section 2 of this
2013 Act. If the mechanic determines after inspection that the
off-road motorcycle complies with the equipment provisions and
other provisions of the vehicle code and the rules adopted by the
department under section 2 of this 2013 Act, the mechanic may
issue a certificate of approval to the owner of the
motorcycle. + }
