It is an editor's brief statement of the essential features of the measure as introduced. Requires State Department of Agriculture to conduct sampling and develop estimate of extent to which misbranded fish, shellfish or other seafood, and misbranded packaged foods containing fish, shellfish or other seafood, are present in food supply of state. Requires department to report estimate to interim committees of Legislative Assembly no later than October 1, 2014. Declares emergency, effective on passage. A BILL FOR AN ACT Relating to misbranded foods; and declaring an emergency. Be It Enacted by the People of the State of Oregon: SECTION 1. { + (1) As used in this section, 'misbranded' means meeting one or more criteria for being deemed misbranded under ORS 616.250. (2) The State Department of Agriculture shall conduct samplings of fish, shellfish and other seafood offered for sale for human consumption in this state, and of packaged foods offered for sale for human consumption in this state that contain fish, shellfish or other seafood. The department shall provide for the samples of fish, shellfish and other seafood to be analyzed for the purpose of determining whether the sampled fish, shellfish or other seafood is misbranded. The department shall provide for the samples of packaged foods to be analyzed to determine whether the fish, shellfish or other seafood contained in the packaged food causes the packaged food to be misbranded. The department shall use the information gathered from the sampling and analysis process to develop an estimate of: (a) The extent to which misbranded fish, shellfish or other seafood is present in the food supply of this state; and (b) The extent to which fish, shellfish or other seafood causes misbranded packaged food to be present in the food supply of this state. (3) The department shall report the estimate made by the department under subsection (2) of this section to the appropriate interim committees of the Seventy-seventh Legislative Assembly in the manner provided by ORS 192.245 no later than October 1, 2014. + } SECTION 2. { + This 2013 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2013 Act takes effect on its passage. + } ----------
