AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for

3

sentencing procedure for murder of the first degree.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 9711(d)(1) of Title 42 of the

7

Pennsylvania Consolidated Statutes is amended to read:

8

§ 9711.  Sentencing procedure for murder of the first degree.

(d)  Aggravating circumstances.--Aggravating circumstances

11

shall be limited to the following:

12

(1)  The victim was a firefighter, peace officer, public

13

servant concerned in official detention, as defined in 18

14

Pa.C.S. § 5121 (relating to escape), judge of any court in

15

the unified judicial system, the Attorney General of

16

Pennsylvania, a deputy attorney general, district attorney,

17

assistant district attorney, member of the General Assembly,

18

Governor, [Lieutenant Governor,] Auditor General, State

Treasurer, State law enforcement official, local law

2

enforcement official, Federal law enforcement official or

3

person employed to assist or assisting any law enforcement

4

official in the performance of his duties, who was killed in

5

the performance of his duties or as a result of his official

6

position.

Section 2.  Upon the ratification of the amendment to the

9

Constitution of Pennsylvania abolishing the office of Lieutenant

10

Governor, the Secretary of the Commonwealth shall cause the date

11

of ratification to be published in the Pennsylvania Bulletin.

Section 3.  This act shall take effect as follows:

13

(1)  Section 2 of this act and this section shall take

14

effect immediately.

15

(2)  Section 1 of this act shall take effect upon

16

publication in the Pennsylvania Bulletin of the ratification

17

date of the amendment to the Constitution of Pennsylvania

18

that abolishes the office of Lieutenant Governor.
