| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, further providing for |
3 | sentencing procedure for murder of the first degree. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 9711(d)(1) of Title 42 of the |
7 | Pennsylvania Consolidated Statutes is amended to read: |
8 | § 9711. Sentencing procedure for murder of the first degree. |

10 | (d) Aggravating circumstances.--Aggravating circumstances |
11 | shall be limited to the following: |
12 | (1) The victim was a firefighter, peace officer, public |
13 | servant concerned in official detention, as defined in 18 |
14 | Pa.C.S. § 5121 (relating to escape), judge of any court in |
15 | the unified judicial system, the Attorney General of |
16 | Pennsylvania, a deputy attorney general, district attorney, |
17 | assistant district attorney, member of the General Assembly, |
18 | Governor, [Lieutenant Governor,] Auditor General, State |

1 | Treasurer, State law enforcement official, local law |
2 | enforcement official, Federal law enforcement official or |
3 | person employed to assist or assisting any law enforcement |
4 | official in the performance of his duties, who was killed in |
5 | the performance of his duties or as a result of his official |
6 | position. |

8 | Section 2. Upon the ratification of the amendment to the |
9 | Constitution of Pennsylvania abolishing the office of Lieutenant |
10 | Governor, the Secretary of the Commonwealth shall cause the date |
11 | of ratification to be published in the Pennsylvania Bulletin. |
12 | Section 3. This act shall take effect as follows: |
13 | (1) Section 2 of this act and this section shall take |
14 | effect immediately. |
15 | (2) Section 1 of this act shall take effect upon |
16 | publication in the Pennsylvania Bulletin of the ratification |
17 | date of the amendment to the Constitution of Pennsylvania |
18 | that abolishes the office of Lieutenant Governor. |
