AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

Pennsylvania Consolidated Statutes, further providing for

sentencing procedure for murder of the first degree.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 9711(d) of Title 42 of the Pennsylvania

7

Consolidated Statutes is amended by adding a paragraph

(d)  Aggravating circumstances.--Aggravating circumstances

shall be limited to the following:

(19)  The victim was over 60 years of age or the victim

was particularly vulnerable due to old age, infirmity or

disability.

(20)  The defendant perpetrated a sexually violent

offense as defined in section 9792 (relating to definitions)

against the victim and, at the time of the killing, the

defendant was required to register pursuant to Subchapter H

4

(relating to registration of sexual offenders).
