AN ACT

  

1

Amending the act of October 18, 1988 (P.L.756, No.108), entitled

2

"An act providing for the cleanup of hazardous waste sites;

3

providing further powers and duties of the Department of

4

Environmental Resources and the Environmental Quality Board;

5

providing for response and investigations for liability and

6

cost recovery; establishing the Hazardous Sites Cleanup Fund;

7

providing for certain fees and for enforcement, remedies and

8

penalties; and repealing certain provisions relating to the

9

rate of the capital stock franchise tax," further providing

10

for the fund and for civil penalties.

The General Assembly of the Commonwealth of Pennsylvania

12

hereby enacts as follows:

13

Section 1.  Section 901(c) of the act of October 18, 1988

14

(P.L.756, No.108), known as the Hazardous Sites Cleanup Act, is

15

amended by adding a paragraph to read:

Section 901.  Fund.

(c)  Funds.--Money from the following sources shall be

deposited in the fund:

(10)  Civil penalties assessed under section 1104.

Section 2.  Section 1104 of the act is amended by adding a

2

subsection to read:

Section 1104.  Civil penalties.

(f)  Deposit into fund.--Civil penalties assessed under this

6

section shall be deposited in the Hazardous Sites Cleanup Fund

7

established in section 602.3 of the act of March 4, 1971 (P.L.6,

8

No.2), known as the Tax Reform Code of 1971.

Section 3.  This act shall take effect in 60 days.
