AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, further providing for retail theft.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Section 3929(b)(1.1) of Title 18 of the

6

Pennsylvania Consolidated Statutes is amended to read:

7

§ 3929.  Retail theft.

(b) Grading.--

(1.1)  Any person who is convicted under subsection (a)

12

of retail theft of motor fuel may, in addition to any other

13

penalty imposed, be sentenced as follows:

14

(i)  For a first offense, to pay a fine of not less

15

than $100 nor more than $250 and to have the person's

16

operating privilege suspended for 30 days.

(ii)  For a second offense, to pay a fine of not less

18

than $250 nor more than $500 and to have the person's

operating privilege suspended for 60 days.

(iii)  For a third or subsequent offense, to pay a

3

fine of not less than $500[, or the court may order the]

4

and to have the person's operating privilege [of the

5

person] suspended [for 30 days] for one year. A copy of

6

the order shall be transmitted to the Department of

7

Transportation.

Section 2.  This act shall take effect in 60 days.
