A BILL TO BE ENTITLED
 
AN ACT
  relating to suspending Employees Retirement System of Texas annuity
  payments for employees who return to work for the state.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 812.203(a), Government Code, is amended
  to read as follows:
         (a)  Except as provided by Section 812.202, if [If] a retiree
  takes the oath for a position included in the elected class of
  membership or takes a position included in the employee class, the
  retirement system shall suspend annuity payments to the person for
  service that was credited in the elected or employee [that] class,
  as applicable, until the person no longer holds that position.
         SECTION 2.  Section 812.202(b), Government Code, is
  repealed.
         SECTION 3.  The change in law made by this Act applies only
  to a retiree of the Employees Retirement System of Texas who resumes
  work with this state on or after the effective date of this Act. A
  retiree who resumes work with this state before the effective date
  of this Act is subject to the law in effect on the date the employee
  resumes work, and that law is continued in effect for that purpose.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
