| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 130.306, Education Code, is amended by | ||
| amending Subsection (b) and adding Subsections (d) and (e) to read | ||
| as follows: | ||
| (b) Except as otherwise provided by this section | ||

| degree program under this subchapter may not offer more than three | ||
| baccalaureate degree programs at any time. | ||
| (d) A public junior college offering a baccalaureate degree | ||
| program under this subchapter that is located in a county with a | ||
| population of more than 1,700,000 based on United States Census | ||
| 2010 data and that is located within 180 miles of the Texas-Mexico | ||
| border may not offer more than five baccalaureate degree programs | ||
| at any time. | ||
| (e) At any time, South Texas College may not offer more than | ||
| six baccalaureate degree programs under this subchapter. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
