A BILL TO BE ENTITLED
 
AN ACT
  relating to transferring data analysis and certain reporting
  functions from the Department of Family and Protective Services to
  the Texas Tech University System.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 40, Human Resources Code,
  is amended by adding Section 40.0029 to read as follows:
         Sec. 40.0029.  POWERS AND DUTIES RELATED TO DATA ANALYTICS
  AND CERTAIN REPORTS.  (a) A function of the department related to
  analyzing data collected by the department and producing and
  submitting a report related to that data is transferred to the Texas
  Tech University System.  The department shall provide the Texas
  Tech University System with access to the department's data and
  automated case tracking and information management system.
         (b)  The department and the Texas Tech University System
  shall enter into a memorandum of understanding that establishes a
  plan for providing the university system with access to the
  department's data and automated case tracking and information
  management system used for purposes of analyzing and reporting data
  collected by the department to the legislature or any statewide
  officeholder.
         (c)  In this code or any other law, a reference to the
  department in relation to analyzing data collected by the
  department and the submission of reports to the legislature and
  statewide officeholders regarding that data means the Texas Tech
  University System.
         (d)  Not later than December 1, 2023, the department and the
  Texas Tech University System shall enter into the memorandum of
  understanding required by Subsection (b). This subsection expires
  December 1, 2024.
         SECTION 2.  Subchapter A, Chapter 264, Family Code, is
  amended by adding Section 264.0171 to read as follows:
         Sec. 264.0171.  DATA ANALYTICS AND CERTAIN REPORTS.  (a)  In
  accordance with Section 40.0029, Human Resources Code, a reference
  in this chapter and Chapter 265 to the department in relation to
  analyzing data collected by the department and producing and
  submitting a report related to that data means the Texas Tech
  University System.
         (b)  Notwithstanding any other law, the Texas Tech
  University System shall analyze data collected by the department
  and produce and submit any reports to the legislature or statewide
  officeholders previously produced and submitted by the department.
         SECTION 3.  On September 1, 2023:
               (1)  all functions and activities related to analyzing
  data collected by the Department of Family and Protective Services
  and submitting reports to the legislature and statewide
  officeholders regarding that data performed by the Department of
  Family and Protective Services immediately before that date are
  transferred to the Texas Tech University System;
               (2)  the unexpended and unobligated balance of any
  money appropriated by the legislature for the Department of Family
  and Protective Services related to analyzing data collected by the
  Department of Family and Protective Services and submitting reports
  to the legislature and statewide officeholders regarding that data
  is transferred to the Texas Tech University System; and
               (3)  a reference in law or an administrative rule to the
  Department of Family and Protective Services related to analyzing
  data collected by the Department of Family and Protective Services
  and submitting reports to the legislature and statewide
  officeholders regarding that data means the Texas Tech University
  System.
         SECTION 4.  This Act takes effect September 1, 2023.
