age policies imposed by commercial lodging establishments. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subtitle C, Title 5, Business & Commerce Code, is | ||
amended by adding Chapter 114 to read as follows: | ||
CHAPTER 114. MINIMUM AGE POLICIES OF COMMERCIAL LODGING | ||
ESTABLISHMENTS | ||
Sec. 114.001. DEFINITIONS. In this chapter: | ||
(1) "Commercial lodging establishment" means a hotel, | ||
motel, inn, or similar entity that offers lodging to the public in | ||
exchange for compensation. | ||
(2) "Military service member" means a member of: | ||
(A) the armed forces of the United States; | ||
(B) the Texas National Guard or the National | ||
Guard of another state serving on active duty under an order of the | ||
president of the United States; | ||
(C) a reserve component of the armed forces of | ||
the United States who is on active duty under an order of the | ||
president of the United States; or | ||
(D) the Texas military forces serving on state | ||
active duty. | ||
Sec. 114.002. MINIMUM AGE POLICY FOR LODGING WAIVED FOR | ||
MILITARY SERVICE MEMBERS. A commercial lodging establishment that | ||
imposes a minimum age policy that denies or restricts lodging to | ||
individuals based on age shall waive that policy for a military | ||
service member who: | ||
(1) seeks to obtain lodging at the establishment; and | ||
(2) presents a valid military identification card. | ||
SECTION 2. This Act takes effect September 1, 2019. |
