A BILL TO BE ENTITLED
 
AN ACT
  relating to applicability to military service members of minimum
  age policies imposed by commercial lodging establishments.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle C, Title 5, Business & Commerce Code, is
  amended by adding Chapter 114 to read as follows:
  CHAPTER 114.  MINIMUM AGE POLICIES OF COMMERCIAL LODGING
  ESTABLISHMENTS
         Sec. 114.001.  DEFINITIONS. In this chapter:
               (1)  "Commercial lodging establishment" means a hotel,
  motel, inn, or similar entity that offers lodging to the public in
  exchange for compensation.
               (2)  "Military service member" means a member of:
                     (A)  the armed forces of the United States;
                     (B)  the Texas National Guard or the National
  Guard of another state serving on active duty under an order of the
  president of the United States;
                     (C)  a reserve component of the armed forces of
  the United States who is on active duty under an order of the
  president of the United States; or
                     (D)  the Texas military forces serving on state
  active duty.
         Sec. 114.002.  MINIMUM AGE POLICY FOR LODGING WAIVED FOR
  MILITARY SERVICE MEMBERS. A commercial lodging establishment that
  imposes a minimum age policy that denies or restricts lodging to
  individuals based on age shall waive that policy for a military
  service member who:
               (1)  seeks to obtain lodging at the establishment; and
               (2)  presents a valid military identification card.
         SECTION 2.  This Act takes effect September 1, 2019.
